Following are the legal guidelines for your use of the Attachmate File Library. By using this service, you agree to the terms set forth below titled "Attachmate File Library Rules and Conditions." We strongly suggest you review the rules and conditions prior to using this File Library service.

USING THIS SERVICE CONSTITUTES YOUR AGREEMENT TO ABIDE BY ALL RULES AND CONDITIONS SET FORTH IN THIS DOCUMENT--THESE RULES AND CONDITIONS MAY BE CHANGED FROM TIME TO TIME. PURSUANT TO THE ELECTRONIC COMMUNICATIONS PRIVACY ACT OF 1986 (18 U.S.C., 2510 et. seq.), NOTICE IS HEREBY GIVEN THAT ALL MATERIALS ON THIS SERVICE ARE READABLE BY ANYONE USING THIS SERVICE, INCLUDING THE SYSTEM OPERATOR, AND ATTACHMATE CORPORATION OFFERS NO PROTECTION TO ANY PRIVATE, CONFIDENTIAL OR PRIVILEGED INFORMATION ELECTRONICALLY COMMUNICATED TO OR FROM THIS SERVICE.

Attachmate File Library Rules and Conditions

The term "you," "your," and "user" refers to you and all users of the Attachmate File Library. The terms "this File Library," "the File Library," and "File Library," refer to Attachmate's File Library.

  1. You agree that neither Attachmate Corporation nor other users of the File Library shall be responsible or liable for: (i) any and all loss or damage to any files downloaded from this File Library; (ii) any and all loss or damage to your hardware or software; (iii) any and all costs, expenses, losses and damages resulting from your reliance on any information contained in or obtained from this File Library; (iv) any claim of copyright, patent, trademark or trade secret infringement resulting from a file uploaded to the File Library or information put on the File Library by a user; (v) any and all costs, expenses, losses, and damages, including without limitation, direct damages, consequential damages, and damages for loss of business profits, business interruption, and loss of business information, arising out of the use or inability to use the File Library and its information and files. You agree to indemnify and hold Attachmate Corporation harmless from and against any claim of copyright, patent, trademark or trade secret infringement asserted by a third party against Attachmate as a result of any file uploaded to the File Library or information put on the File Library by you.

  2. You acknowledge that all information obtained from the File Library is provided "AS IS" without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

  3. You agree not to share, with any other department or entity, any program fixes downloaded solely for your use without express permission from Attachmate Corporation.

  4. Information and files on the File Library are subject to change without notice. Attachmate Corporation reserves the right to review and delete any and all files, or other communications on the File Library.

  5. Violation of the rules and conditions stated herein may result in your being denied access to the File Library, temporarily or permanently. Your access to the File Library is solely at the discretion of Attachmate Corporation.
