The Governor in Council on the report and recommendation of the Minister of Justice dated March 14, 1996, pursuant to Section 27 of Chapter 292 of the Revised Statutes of Nova Scotia, 1989, the Motor Carrier Act, is pleased to:
(a) approve of the amendments to the Board Public Passenger Motor Carrier Act regulations made by the Nova Scotia Utility and Review Board and approved by Order in Council 92-1257, dated December 22, 1992, in the manner set forth in Schedule "A" attached to and forming part of the report and recommendation; and
(b) make amendments to the Governor in Council Public Passenger Motor Carrier Act regulations made by Order in Council 92-1258, dated December 22, 1992, in the manner set forth in Schedule "B" attached to and forming part of the report and recommendation.

The Governor in Council on the joint report and recommendation of the Minister of Finance and the Minister responsible for the Liquor Control Act, dated February 28, 1996, and pursuant to subclause 20(b)(iii) of Chapter 377 of the Revised Statutes, 1989, as amended, the Public Service Superannuation Act, is pleased to:
(a) repeal, effective February 29, 1996, Order in Council 92-977, dated September 29, 1992;
(b) repeal, effective February 29, 1996, Order in Council 86-584, dated May 27, 1986; and
(c) determine that the service of Peter J. MacKeigan as a member and Chairman of the Nova Scotia Liquor Commission, during the period October 28, 1985 through December 31, 1991, be deemed to be and to have been service in the public service of Nova Scotia for the purpose of the Public Service Superannuation Act, provided the full actuarial cost of such service, as determined by the Minister of Finance, is paid to the Superannuation Fund.

The Governor in Council on the report and recommendation of the Minister of Finance and the Minister responsible for the Economic Renewal Agency dated February 29, 1996, and pursuant to Section 72 of Chapter 365 of the Revised Statutes, 1989, the Provincial Finance Act, is pleased to order:
(a) that the offering of securities referred to in the Resolution of the Board of Directors of Nova Scotia Government Fund Limited attached as Schedule "A" to the report and recommendation of the Minister of Finance and the Minister responsible for the Economic Renewal Agency, dated February 29, 1996, be and the same is hereby approved;
(b) that the President and the Secretary of Nova Scotia Government Fund Limited and each of them is hereby authorized for and in the name of Nova Scotia Government Fund Limited to execute and deliver under the corporate seal or otherwise all such other documents and to do all such other acts and things as may be necessary or desirable to give effect to this Order.

The Governor in Council on the report and recommendation of the Minister of Finance dated March 8, 1996, pursuant to Section 54 of Chapter 461 of the Revised Statutes of Nova Scotia, 1989, the Teachers' Pension Act, is pleased to amend the Nova Scotia Teachers' Early Retirement Program (1994-1998) Regulations to provide for retirements at the end of a term, semester or school year in the manner set forth in Schedule "A" attached to and forming part of the report and recommendation effective on, from and after April 2, 1996.

The Governor in Council on the report and recommendation of the Minister of Finance dated March 18, 1996, pursuant to Section 12 of Chapter 301 of the Revised Statutes of Nova Scotia, 1989, as amended, the Municipal Finance Corporation Act, and a Resolution of the .Corporation passed December 14, 1979, and amended March 27, 1992, authorized by paragraph 11(c) of the aforesaid Act, a copy of which Resolution, is attached to the said report and recommendation, is pleased to:
(a) authorize the Minister of Finance to guarantee on behalf of Her Majesty the Queen in right of the Province of Nova Scotia advances from time to time to Nova Scotia Municipal Finance Corporation by way of loan, overdraft or the extension of a line of credit from or by The Bank of Nova Scotia up to the amount of $5,000,000.00 which amount includes principal and interest thereon at no greater than the prime rate of interest established from time to time by The Bank of Nova Scotia on Canadian dollar loans to its best customers, for a period to expire midnight, March 31, 1997, upon such terms and conditions as are set out in such guarantee or as the Minister of Finance may require; and
(b) further authorize the Minister of Finance to execute any guarantees, documents or instruments as the Minister deems necessary and to do any other act or thing necessary or incidental to give such guarantee or guarantees.

The Governor in Council on the report and recommendation of the Minister of Transportation and Communications dated March 19, 1996, and pursuant to Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to approve the expropriation by Her Majesty the Queen in the Right of the Province of Nova Scotia, of 0.217 hectares, more or less, of land situate, lying and being at or near the District of Westville, in the County of Pictou, Province of Nova Scotia, and being more particularly described in Schedule "A" and shown outlined in red on a plan marked Schedule "B" which schedules are attached to and form part of the said report and recommendation of the Minister of Transportation and Communications, the said expropriation being for a public purpose; namely, for the purpose of a public highway.

(a) extinguish the right of the public to use that portion of the public highway system containing 1,800 square feet, more or less, situate at or near Ketch Harbour, Halifax County, and more particularly described in Schedule "A" which is attached to and forming part of the report and recommendation;
(b) convey the said lands to Robert James Plested and Lorraine Cecelia Benoit, of Ketch Harbour, Halifax County, for the price of $250.00; and
(c) authorize the Minister of Transportation and Communications to make and execute a Deed of Conveyance in such form as the Minister determines.

(a) extinguish the right of the public to use that portion of the public highway system containing 0.415 acre, more or less, situate at or near Voglers Cove, Lunenburg County, and more particularly described in Schedule "A" which is attached to and forming part of the report and recommendation;

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated March 22, 1996, pursuant to Section 25 of Chapter 5 of the Acts of 1994-95, the Innovation Corporation Act, is pleased to order and declare that:
(a) effective April 1, 1996, all the right, title and interest of the Nova Scotia Research Foundation Corporation and all rights and privileges of the Nova Scotia Research Foundation Corporation are vested in the Nova Scotia Innovation Corporation;
(b) effective April 1, 1996, all the obligations of the Nova Scotia Research Foundation Corporation are the obligations of the Nova Scotia Innovation Corporation;
(c) effective April 1, 1996, the Nova Scotia Research Foundation Corporation is dissolved; and
(d) effective April 1, 1996, Chapter 450 of the Revised Statutes of Nova Scotia, 1989, the Research Foundation Corporation Act, is repealed.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated March 27, 1996, and pursuant to clause 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the issuance of a grant and or deed by the Minister of Natural Resources to convey a parcel of Crown land containing an area of 1500 square feet, more or less, situate at Cheticamp, Inverness County, and shown outlined in red on the plan marked Schedule "A" attached to and forming part of the report and recommendation, to Jeannot Chiasson of Cheticamp, Inverness County, for the consideration of $0.50 per square foot, the exact amount to be determined by survey, and to authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.

The Governor in Council on the report and recommendation of the Minister of Human Resources dated March 28, 1996, pursuant to Section 88 of Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, is pleased to amend the Early Retirement Incentive Program (1994-1998) Regulations made by the Governor in Council by Order in Council 94-117 dated February 8, 1994, in the manner set forth in Schedule "A" attached to and forming part of the report and recommendation, effective on, from and after April 1, 1996.

The Governor in Council on the report and recommendation of the Minister of Human Resources dated April 2, 1996, pursuant to Section 20 of Chapter 11 of the Statutes of Nova Scotia, 1994, the Public Sector Compensation (1994-97) Act and to Section 6 of the regulations made pursuant thereto by Order in Council 94-631 on August 3, 1994, is pleased to:
(a) revoke the appointment of George L. Fox as Administrator and Chief Executive Officer of the Public Sector Compensation Restraint Board, effective on and from April 10, 1996;
(b) appoint Donald Nelson, Corporate Services, Department of Human Resources, as Administrator and as Chief Executive Officer of the same Board, on and from April 10, 1996;
(c) provide that the Chief Executive Officer of the Board shall continue to be reimbursed for expenses in accordance with government policies applicable to civil servants.

The Governor in Council on the report and recommendation of the Minister of Supply and Services dated February 9, 1996, pursuant to Section 11 of Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, is pleased to:
(a) authorize the Minister of Supply and Services to sell and convey to Canadian Shopping Centres Limited the property more particularly shown in Schedule "A" attached to and forming part of the report and recommendation for the approximate amount of One Hundred Four Thousand Six Hundred Dollars ($104,600.00) subject to adjustment after a survey of the property to determine the exact area of land, which sale shall be on the terms and conditions as are satisfactory to the Attorney General;
(b) authorize the Minister of Supply and Services on behalf of Her Majesty the Queen in right of the Province of Nova Scotia to execute such documents and agreements as may be required in connection with this sale and conveyance; and
(c) direct the Minister of Supply and Services to forward the proceeds of the sale to the Minister of Finance for the Province of Nova Scotia to be deposited to the credit of Her Majesty the Queen in right of the Province of Nova Scotia in an appropriate account.

(b) approve the issuance of a lease by the Minister of Natural Resources of a parcel of Crown land five metres wide and ten kilometres in length, more or less, situate at Upper Clements, Annapolis County, as described in Schedule "A" and shown on Schedule "B", on the terms and conditions as set out in Schedule "C", all Schedules attached to and forming part of the report and recommendation, to the Upper Clements Wildlife Park Society, a Society with its head office at Upper Clements, Annapolis County, for the purposes of maintaining and operating recreational trails open to the general public and for no other purpose, for a term of three (3) years, subject to termination in the event the lease of the Upper Clements Wildlife Park terminates, at the annual rent of one dollar ($1.00) with the right to renew the lease for a further three (3) year term at a rent to be fixed by the Lessor, provided that the Lessee has satisfactorily complied with the terms and conditions of the lease and provided that the Lessee's lease of the Upper Clements Wildlife Park has not terminated and is in good standing.

The cost allocation is $1,000,000.00 for the Heating and Ventilation System, $250,000.00 for the communication system and $250,000.00 for the space requirements for a total amount not to exceed $1,500,000.00 (one million, five hundred thousand dollars), which grant is to be paid on the basis of invoiced costs submitted to the Department of Health and charged to Capital Account, for the vote "Capital Grants, Capital Construction Projects", under the heading "Capital Grants, Department of Health".

The Governor in Council on the report and recommendation of the Minister responsible for Part II of the Gaming Control Act dated February 13, 1996, and pursuant to subsection 40(2) of Chapter 4 of the Statutes of Nova Scotia, 1994-95, the Gaming Control Act, Section 5 of Chapter 466 of the Revised Statutes of Nova Scotia, 1989, the Theatres and Amusements Act, and Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, is pleased to:
(a) amalgamate the Amusements Regulation Board with the Nova Scotia Gaming Control Commission;
(b) determine the name of the new body to be the Nova Scotia Gaming Control Commission;
(c) determine that the present members, Chair and Vice-Chair of the Nova Scotia Gaming Control Commission shall continue as members, Chair and Vice-Chair of the new amalgamated body on the same terms and conditions as their original appointment to the Commission;
(d) revoke the appointment of all other persons appointed to be members of the Amusements Regulation Board, all to be effective on and from February 15, 1996;
(e) designate the new amalgamated Commission as the licensing authority, pursuant to the power of the Lieutenant Governor in Council of Nova Scotia under S.207 of the Criminal Code of Canada, R.S.C. 1985, c. C-46, as amended, and transferring all previous power and authority of the present Nova Scotia Gaming Control Commission to the amalgamated body.

(a) subject to the terms and conditions outlined in paragraph (b), authorize the conveyance by deed or grant of a lot of Crown land containing 11.23 acres± situate at Villagedale, Shelburne County, to Stanley and Bernadette Lamrock, the Crown land being more fully shown outlined in green on the plan marked Schedule "A" attached to and forming part of the report and recommendation;
(b) in exchange for the Crown lot noted in paragraph (a), accept on behalf of Her Majesty the Queen in right of the Province of Nova Scotia from Stanley and Bernadette Lamrock 2 lots of land containing a total of 1.3 acres± situate at Villagedale, Shelburne County, being more fully shown outlined in red on the plan marked Schedule "A" attached to and forming part of the report and recommendation, subject to the condition that Stanley and Bernadette Lamrock be able to certify title to their land in a manner deemed sufficient by the Department of Justice; and
(c) to authorize the Minister of Natural Resources to prepare and have executed such documents as may be necessary to achieve the purpose of this Order.
