Monday, July 17, 2000 -- Federal Judge Breyer ruled that Medical Necessity applies to Sales of Marijuana in the ongoing federal case involving the federal injunction against the Cannabis Buyers Clubs in California.

"Once again, however, the Court must caution as to what this decision does not do. The Court has not declared Proposition 215 unconstitutional. Nor has it enjoined the possession of marijuana by a seriously ill patient for the patient’s personal medical use upon a physician’s recommendation. Nor has the Court foreclosed the possibility of a medical necessity or constitutional defense in any proceeding in which it is alleged a defendant has violated the injunction issued herein." --  Hon. Dennis Peron Trial: Next Court date: "to be announced" on the seventh floor of the Alameda County Courthouse -- Alameda County. Latest news: Yet another inexplicable delay occurred on August 14th. Previous Delay was that the judge took another day off (August 7, 2000) -- Delays beyond our control, first the Prosecutor had some terrible trouble, then the judge took the day off, so now were looking at mid August to set trial date. Oh well this story will be told! -- Lockyer still wants a war!! February 1, 2000 --  A letter from Assemblywoman Audie Bock demonstrating once again how Lockyer is turning a cold shoulder to input from Prop 215's author and many prominent California Politicians who agree with Dennis about changing the sales law instead of selectively prosecuting key cases.  Lockyer confirms that he won't even update the guidelines still in place from the Lungren years. That's two (2) plants per patient. So much for compassion and understanding from the liberal democrats.

It's coming slowly back to life and could actually be on Governor Davis's Desk by mid July. Newest news is that is is technically in the Assembly Inactive file but is getting a lower file number on a regular basis and could be sneaking toward the floor. Watch carefully friends... This Bill is a bad idea!
