This site is dedicated to our dear son and brother Kevin Mackle, who was found dead in his Residence at Kuehner Hall, Bishop's University, Lennoxville Quebec on December 13th 1998, a day of sorrow for us, his family. A toppled Vendo Model Coca-Cola Machine which was put in place, unsecured, by the Beaver Foods Company crushed him. On October 19th 1999, almost a year after Kevin's death, the Quebec Coroner, Dr. Rene Maurice Belanger issued a Coroner's Report on what he considered to be the facts of the case.

Kevin would now be in his third year of study at Bishop's University -instead, we are in our third year of trying to ascertain just what happened on that night. He went away in September 1998, with hope and enthusiasm, and was returned to us one hundred days later -in a coffin. How can we not wonder and agonise over what could have happened? We want to know how such an appalling accident could have happened, in a small University Residence. We want to know how he could have lain there for five hours, unseen, undiscovered, in a lit, glass fronted lobby, which fronted onto one of the roads within the University?

We have posted this site reluctantly, we were assured that a thorough and definitive investigation would be done, that a Coroner's Inquest was not necessary. Instead we have in hand a Report which is an insult in its brevity, which is full of speculation by the Coroner on what happened in that lobby on that night. This is not a frivolous matter; it is primarily an issue of safety in public spaces and public buildings. There have been many serious deaths and accidents of this kind over the years in North America, and including Quebec. The only time we had a conversation with Dr Belanger - this after much pleading with him to contact us - he informed us that anything previous that happened outside Quebec was irrelevant to his investigation!

Our Goal - to make it a legal requirement that pop machines located in educational institutions, workplaces and public places should be secured so as to prevent any further accidents or deaths.

Everything posted on this site is fact. The only speculation about what happened to Kevin Mackle was on the part of the Coroner, Dr. Belanger in his Report. He had a duty and a public responsibility to gather information, and report on what happened. Instead, he accepted the self-serving explanations offered to him by these companies, Vendo, Coca-Cola, and Beaver Foods, and the University itself. He then presented them as fact in his report and speculated on what he could not explain. For anyone who would doubt his question our lack of confidence in either his integrity or objectivity in this process, they should only ask themselves why he would present his Report at Bishop's University, with the Principal of the Institution at his side, and Representatives of Coca Cola, Vendo and Beaver Foods present, and all ready to offer their self-serving comments to the Press representatives. All this was done without informing us - Kevin's family. We were appalled to read the details in "La Tribune." Dr. Belanger may consider that, having held his press conference with all the groups under investigation at his side, he has performed his public duty as a Coroner. We do not think so.



Questions We Want Answered

1.
How does someone shake a machine without leaving fingerprints? No fingerprints were found on the machine by the police, only "a partial handprint".

Was Kevin really alone or was someone with him who panicked?
3.
Why does the US Government provide Safety regulations when the Canadian Government does not?
4.
What modifications were made to the machine in 1995?
5.
Why was the machine located in the Lobby of a student residence, with no warning stickers in place, in a confined area?
6.
The janitors knew and had seen that the students rocked the pop machine, the ceiling and floor of the Lobby were damaged, by the shaking of it. Why did the Administration do nothing? After Kevin's death the damage to the ceiling in the Lobby was repaired by the University.
7.
Why were no independent experts consulted by Dr. Belanger? The people he did speak to were not objective.
8.
Why did the Sherbrooke Police play at tilting the machine themselves to see if they could tip it? Is not that the role of experts?
9.
Why did Dr. Belanger allow Coca Cola to take back their machine before his Report was even completed? Where is it now?
10.
Why were these questions not pursued by the Coroner's Office?
