Emergency Petitions

Dietary Supplement Health Claims
AAHF filed several emergency petitions addressing the U.S. Food and Drug Administration's regulations on health claims for dietary supplements. We have also filed several citizens' petitions and continue to file comments on proposed agency regulations affecting the free flow of information to consumers.

Medicare List of Covered Services
AAHF filed a Petition for Rulemaking with the U.S. Department of Health and Human Services, requesting the Health Care Financing Administration to require each Medicare carrier to publish twice annually a master list of covered and non-covered services under Part B and, at the end of each year, distribute the list to each participating provider within its jurisdiction, and to make the list available to any provider upon request. We also asked that providers' good faith reliance on a master list in submitting or not submitting a claim for reimbursement is a defense to a charge of abuse or fraud in submitting or not submitting the claim. Although this petition was filed in June of 1998, the Department has yet to respond.
