Welcome to the Netscape SmartDownload Settlement Website

     Netscape Communications Corp. ("Netscape") previously offered to the public a free software program called Netscape SmartDownload ("SmartDownload"). This software facilitated the process for downloading certain types of electronic files - in particular, files having .zip, .exe, or .idp extensions - from Internet websites. As described in the Official Notice that is linked to this website, three putative class action lawsuits concerning SmartDownload were filed four years ago against Netscape and its parent company, America Online, Inc. There is now a proposal to settle those lawsuits on a class-wide basis. The versions of SmartDownload that are the subject of the lawsuits and the proposed settlement were distributed to the public from the Fall of 1998 until October 2000. They include SmartDownload version 1.0, version 1.1, and version 1.2.

     If you installed or used any version of SmartDownload software distributed before October 2000, or made available through the Internet a file that anyone downloaded (or tried to download) using such software, please carefully read the Official Notice (available through the link below) as it may affect your rights.

     You may exclude yourself from the Class and the proposed settlement. If you do so, you will not participate in the Settlement, you will not be bound by the judgments to be entered pursuant to the Settlement, you cannot object to the Settlement, and none of your claims will be released as part of the Settlement. If you want to be excluded, you must mail or deliver, such that is POSTMARKED on or before December 16, 2004, a written request for exclusion to the following address:

Your exclusion request must also comply with the other requirements set forth in the Official Notice.

      If you do not exclude yourself from the Class, you may object to the Settlement. Any objection to the Settlement must comply with the filing, service, and other requirements detailed in the Official Notice, and must be filed and served no later than December 16, 2004.
