It is not a Coincidence That the Call to the Jurisprudence of Minorities Meet with the Plot Aiming at Dividing Islam

The plotting of the leaders of ideological invasion in the world concurred with dividing the single global Islam into various territorial Islams which are supposed to be in dispute and struggle. At the same time voices calling to creating what is called (The Jurisprudence of Minorities) are growing louder and louder in order to make of this religion an Islamic clothing fitting for the Islam which is growing in both the European and American West, regardless of the Islam spreading in the Islamic Homelands in general.

I said inquiring, “What are the bases or documents from which this (Jurisprudence of Minorities) could spring?” In reply, I said, “They are such a lot; i.e., the rule of interests, necessities make the forbidden permissible, hardship brings about facilitation and Allah did not place upon you any compulsion in religion.”

I said, “Such documents are not restricted to the Muslims who live in Europe or America. They seem to be documents for homeless global jurisprudence, and never were at any past time documents for the (Jurisprudence of Minorities) and for no other, because wherever there is necessity, within the legal known sense of the word, forbiddance that causes it is canceled. Wherever there is a hardship exceeding the normal limit, the legal permission which warrants canceling it persists. Whenever two interests contrast on the code of the legal intentions, the first is given privilege. In addition, we have never read in the Holy Qur’an, in the prophetic tradition or in what the Imams (Leaders) of Islamic Law said that such documents are special for the circumstances of minorities living in lands of disbelief so that other Muslims in the Islamic World are not permitted to follow them or depend on them.

I was inquired, “The necessities - from which the urgent need of the special jurisprudence of those minorities emerges - spring from the reality of their being in non-Islamic societies which have their own characteristics, and by which they are distinguished from the other Islamic societies!”

I replied, “Which Islam decides that the mere existence of a Muslim in a land of disbelief may be considered a necessity that justifies legislating a special Islamic jurisprudence which accords with the currents of disbelief, rebellion and diobedience?!.. Then why did God legislate and enjoin emigration from the land of disbelief to the land of Islam when the Muslim has no way of practicing the Islamic rulings in it? Why did the Messenger (pbuh) not stay among the polytheists in Mecca, depending for such an action on this invention called (The Jurisprudence of Minorities)?”

On the other hand, if mere the existence of Muslims in the land of disbelief may be considered a source of urgent need which justifies inventing new jurisprudence fitting for the circumstances of the land concerned and those residing it, then who may be those that God denotes when He says: {Indeed, those whom the angels take [in death] while wronging themselves– [the angels] will say, "In what [condition] were you?’ They will say, ‘We were oppressed in the land.’ They [the angels] will say, ‘Was not the earth of AllŒh spacious [enough] for you to emigrate therein?’ For those, their refuge is Hell – and evil it is as a destination} [Al-Nisa’ 4/97].

We were so pleased for the growing numbers of Muslims in the West, hoping that their adherence to Islam and their discipline to its codes will result in thawing the Western deviating civilization in the current of the Islamic civilization. But today we know, under the shade of the persistent call to the (Jurisprudence of Minorities), that we are warned of suffering from the opposite of what we were hopeful for. We are warned of thawing the Islamic existence in the current of the deviating Western civilization with a guarantee from this type of jurisprudence.

Accoringly, the leaders of this call, which we have never been familiar with beforehand, have to fear Allah and should know that its only outcome is realizing what is being planned for Islam nowadays; i.e., transforming it into various territorial Islams.

Finally, in our Arab and Islamic world we have a lot of jurisprudential societies which can help us dipense with inventing special spots of reference specialized in this Islamic jurisprudence.
