URGENT! Action Alert Announcement:
ASAP: Phone Appropriators who are allowing H-1B increase to come to Floor

Dear friends of America's programmers, engineers, therapists, scientists... [and ANYONE with a 4 year college degree...]

Rosemary has just informed me that the House Republican Members of the Appropriations Committee have now caved on allowing the H-1B increase to be folded into the giant Omnibus Appropriations Bill that is coming up for a vote today.

Those Members had through yesterday been telling House leaders they didn’t want to do it.

But something changed their minds.

(Please read my “Thursday Update” Alert I sent last night for more details of how this has been changed to a new 20,000 annual cap category for advanced-degree foreign workers.)

Most important calls to make right now!

Besides the calls I requested in my Thursday Update, the most important calls you can make at this moment to try to minimize the damage of the H-1B increase in visas, are these:

1. Look on the list below and find your state. Call any Members of the House or Senate Appropriations Committee who are on that list. Those are the calls that will be most accepted and weighed seriously in those offices.

2. If you are really worked up about this and want to blow off some steam that will be of less benefit but of some benefit nonetheless, then call Members from other states, too.

The message

Your action request is for the Member to do everything possible to keep the H-1B increase out of the Omnibus Appropriations bill.

We do not know which Members of Appropriations may or may not have spoken up for American tech workers. We DO know that as a group, the Committee Members let the H-1B increase get into the Omnibus bill at this moment.

We CAN be sure that nearly all the Members are guilty.

Express your deep displeasure at this happening. Unless you know that the Member has a good record on protecting tech workers, you might as well talk as if the Member sold you out on the Omnibus bill.

The main point here is to counter the thoughts that these folks had that they could do this without any political pain or particularly being noticed.

If you get a big protest that the Member had tried to stand up for you, get details and pass them on to us ASAP. And thank them. I don't think you'll hear that from more than one or two on this whole list.


Use any time you get to decry the fact that this provision will mean that 20,000 MORE American tech workers will be without a job during the next year because this Member decided that historic high unemployment among tech workers wasn't high enough and needed more foreign workers.

Be sure to mention that thousands of Americans with graduate degrees are unemployed and underemployed because the tech industry doesn't have jobs for them.

If you haven't noticed the one yet, I'll be explicit and note that these calls are outrage calls which are a desperation move to try to change the results today. They also definitely will discourage Members from pulling this kind of stunt again soon.

It is imperative that you call them before the bill comes to the floor.

If they ask who told you to call...

We are getting reports from many of you this morning who already are making the leadership calls.

Leadership apparently is getting a LOT of calls. Staffers are asking who is running this calling campaign.

Although NumbersUSA has nothing to be ashamed of if we are named, the best approach for the offices to understand that there is a BROAD opposition to this kind of thing.

You might just want to say that the Internet and radio are full of alerts, emails, blogs about the sell-out of the American worker. And that people are following developments by the hour.

You can also say that you are hearing from a lot of organizations representing America's engineers and programmers, from the AFL-CIO and from immigration groups.

Please do not hold off calling. The calls only count if you do them now. It will soon be too late.

We need every one of you who reads this in time to pick up that phone and make a call or two. If you don't do it, who will be there to stand up for America's tech workers and students?

Congress ready to put cheap & illegal labor over U.S. workers & security.........Last chance to call

The outlook on Capitol Hill tonight is pretty grim.

On the plus side, your incredible phoning and faxing this week to stop a gigantic loophole for foreign tech workers appears to have led to a much narrower H-1B visa expansion (see below for details).

But Congress is almost certain tomorrow to vote for an increase in foreign tech workers while U.S. tech workers have higher unemployment than the general population! We might call this the Voter Retribution Bill (motto: Punish The Voters and Import a New Electorate).

And the Republican and Democratic leaders of the House and Senate have almost certainly decided to strip from the 9/11 Response Bill nearly all provisions that would have fought illegal immigration.

As soon as we find out exactly what negotiations produce tonight, we will come to you first thing in the morning with emergency requests for action. We probably will ask for a huge effort to persuade your Member of the House to vote against a rule to bring the 9/11 bill to the floor.

The families of 9/11 victims who are in the 9/11 Families for a Secure America say it is better to have no bill at all than to pass one that does not address the immigration loopholes that were the key ways that the terrorists were able to kill their family members.


1. H-1B UPDATE........Visa increase still moving forward but loophole may be dead

Your phoning and faxing this week totally caught the foreign-worker lobby off guard and unnerved them.

They have been working all day on watering down their visa-increase plan in a last-ditch effort to keep it in the appropriations bill coming to a vote in the next couple of days.

Microsoft and the other tech giants had figured that the nation would be distracted by the elections and not paying attention when they persuaded Sen. Chambliss (R-GA) and Sen. Kennedy (D-MA) to sneak a giant loophole into the end-of-year, must-pass omnibus spending bill.

But our Hill Team reports that your protest has genuinely caught many supporters of the sneak attack off guard. They are a little wobbly-kneed to have been outed and to receive such vigorous opposition.

Because of your opposition the H-1B attachment has been scaled back considerably. It has been improved in these ways (according to our sources):

A. Sec. 203 has been removed. That would have cut the wages of some H-1B workers and, therefore, created downward pressure on all Americans' wages. The importation of H-1B foreign workers will still depress tech wages, but not by as much and not by law.

B. The loophole has been removed. That loophole would have allowed an UNLIMITED number of foreign skilled workers to take U.S. jobs if they simply came to a U.S. college and earned a Masters degree or better. Millions of ambitious parents around the globe would have seen this as the perfect loophole to establish their children in the United States as anchors for the whole family. University enrollments would have exploded with foreign admissions and tech and other skilled occupations would have been flooded with the foreign competition.

C. Instead of allowing an UNLIMITED number of H-1B workers with Masters degrees, the proposal now apparently in effect creates a new category for foreign workers with the graduate degrees and caps it at 20,000 per year.

The AFL-CIO had estimated that without a cap the exempted category would have brought in an additional 30,000 to 40,000 foreign workers in the first year or two. Then that number would have gone up dramatically once the world caught on to the loophole.

So, a 20,000 cap indeed limits the majority of the potential damage of the original Chambliss/Kennedy proposal.

Nonetheless, it is a 30% increase over the 65,000 H-1B visas now offered each year, further attacking a beleaguered U.S. occupational force.

And the visa system remains entirely fraudulant so that there are virtually no controls to limit the visas to foreign workers of exceptional skill who fill jobs for which there truly are no American workers.

The pressure for raising the visa level was based on the fact that the year's entire 65,000 visa allotment was used up the first day of October which was the first day of the new federal year. You can be sure that the new 20,000 visas will all be used up the first day next year. That is because corporations do a land rush to grab up every single visa and then spend the rest of the year finding ways to scam the system to create "unfillable vacacies" to justify using the visas.

I am indeed sorry for our programmer, engineer and other tech friends who will be further harmed by this action.

But please take some satisfaction in the political pain you have inflicted thus far on the perpetrators of this callous move ... and in the fact that you scaled back their greedy hopes by so much.

2. ACTION.........Make one last set of phone calls and try for a miracle victory

As bad as it looks tonight, it is still possible that the Senate and House leadership could decline at the last moment to put the H-1B increases in the appropriations bill when they bring it to the floor.

We believe your calls are best channeled right now to the top leaders of Congress who act as imperial gatekeepers when nearly all the funding for government gets wrapped up in one bill of thousands of pages.

Republicans control Congress. Because of all the controversy, this provision would not be brought to the floor except with the consent of the top GOP leaders -- House Speaker Hastert and Senate Majority Leader Frist.

Both of them are hearing from an impressive group of influential Republican Members who have written letters and made calls to the two urging them to bar the H-1B increase.

No matter what their staffs may tell you, Hastert and Frist as of today are either encouraging the visa increase or allowing it to move forward. They most definitely are not opposing it or staying neutral.

If you want to save 20,000 jobs this year for American programmers and engineers who otherwise will have to work in other occupations, call Hastert's and Frist's offices and hold them accountable for their leadership (or non-leadership) for the American working families.

You might want to play on the theme of how it will look if the first action of Congress after Republicans have won resoundingly in elections is to fulfill all the worst slams against the party as being a party that favors the rich over the wage-earning families.

Now for the Democrats: Although the Democratic leadership cannot easily derail a plan like this, there is some belief that the Republicans wouldn't even try to pull a stunt like this if they knew the Democrats would put up a squeal.

But, in fact, the Democrats are in on the deed from start to finish. House Minority Leader Pelosi and Senate Minority Leader-Elect Reid have given the green light to this gambit to rob from American tech workers and give to the filthy-rich high-tech robber barons.

Any wonder that the American working class has trouble these days feeling a loyalty to the Democratic Party?

You might want to ask their offices when it might be convenient for them to speak up for the interests of American workers again.

3. ACTION..........Out of state? Call off-hours

One of our super-active faxer/phoners from Florida told me tonight that people should really try to call offices during off-hours if they are not from the same state.

Many offices will ask where you live and have caller-ID to see if you are probably telling the truth. If you are from another state, they tend to dismiss or greatly diminish the value of your call.

But when you call off-hours and if you get an answering machine, you can unload your thoughts without having to give your address. (We always encourage honesty.)

Nonetheless, all of you have a right to talk to the above four people as national leaders. They need to get a taste of what the four corners and the expansive middle of this country thinks about this type of action.


4. HEROES........Some Members of Congress have shown real valor; salute them

All during this week, a few Members of Congress have acted like they believe that those elected to govern are supposed to serve the interests of the governed.

Sen. Byrd (D-WV) and his staff have been in the thick of it scrapping and conniving to try to derail this transfer of jobs from Americans to foreign students.

Sen. Inhoffe (R-OK) and his staff have been especially active in standing for common sense and American workers.

Others that deserve special mention are Rep. Sullivan (R-OK) and Rep. Tancredo (R-CO) in addition to at least a couple of dozen others who have signed letters to their party leaders.

It is a sad day when it can be said that it takes valor to oppose importing more workers when American workers are crying for jobs. But that is the climate in Washington this week. Perhaps it is related to nearly all House Members having Districts drawn so it is almost impossible for them to lose an election and to most Senators being incredibly beholden to those who kept their campaigns funded.


5. OUR MOTTO......We nearly always fight for a miracle victory and at least to win strategic advantage even if we suffer a tactical loss

We have sometimes won by just not giving up and forcing a change in atmospherics at the last moment. There is little chance to surprise yourself by winning if you don't fight to win until the last moment.

More often when we are in seemingly impossible situations like this one, we really do lose a vote. But we try to make the loss as narrow as possible. And we try to make the victory so painful for congressional leaders that they seek to avoid this kind of fight again soon.

I urge all of you who care about this H-1B visa issue to pick up your phones right now and give this one more push throughout Friday.

As for the 9/11 bill in which we helped the House pass some wonderful provisions against illegal immigration, I will offer you a course of action as soon as our Hill team formulates them early tomorrow.

Please make a point of checking your emails early Friday and continuously.

BAD NEWS.......GOP leadership caving on giant H-1B visa loophole.........PHONE NOW!!!!!!

Our Capitol Hill team just learned very discouraging news for unemployed and underemployed American tech workers.

It appears that the Republican leaders in both House and Senate are preparing to cave on the giant H-1B visa loophole.

Only your most vigorous phoning and faxing has any chance of stopping a huge increase in H-1B visas for mostly higher skilled foreign workers (heavily information technology).

The GOP leaders are preparing to allow the loophole to be placed in the omnibus appropriations bill that will be voted late this week in the lame-duck session.

If those leaders allow the insertion, the only way to stop the loophole is to vote down the whole appropriations bill and risk shutting down government. There is close to no chance that either House or Senate would actually vote against whatever is presented.

So, our only hope is to persuade the GOP leaders to back away from their commitment to allow a limitless supply of foreign graduate students to take as many U.S. tech jobs as they desire.

Because all of this is being done in the dark of night, these leaders will be quite surprised if all day Tuesday and Wednesday they are totally bombarded on this issue. You might just shake their confidence about being able to get by with such callousness.

This end-of-session disaster for American tech workers is happening because most Members of Congress have a soft spot in their hearts for the technology industry which pours immense sums of money into both political parties.

They all hope you are not watching and won't say anything. Please prove them wrong.

Because so many of you will be calling the same offies, it is important that you try to personalize your phone messages as much as possible.

I will be giving you a number of talking points. But, if possible, try not to read directly from the talking points. Put your concerns into your own words. Choose combinations for the following and put into your own order.

Options to identify the issue about which you are calling:

a. I'm calling about the omnibus appropriations bill and provisions about H-1B visas.

b. I'm concerned about putting a big increase in H-1B visas in the omnibus appropriations bill.

c. Please express my opinion about adding H-1B visas to the omnibus spending bill.

d. Including H-1B visas in the spending bills this week is my concern.

Options for your action request:

a. I'm asking Sen./Rep. xmxmxmxm to block any H-1B visa increases.

b. Please put me down as totally opposed to increasing the number of H-1B visas.

c. Sen./Rep. xmxmxmx has to stop any attempt to increase foreign workers in the programming and engineering fields.

d. I am hearing that Sen./Rep. is ready to create this giant loophole for more foreign tech workers and am wanting assurance that he will NOT do that.

Fashioning your arguments if given a chance:

a. I hope many of you will mention the Washington Post article from last week that told the tragic personal tales of American programmers and their families forced to live a nomadic existence in order to keep working. How in the world can these Republican leaders be so callous as to immediately the next week threaten the lives of those American workers even more?

b. The loophole is really gigantic. It would exempt from the annual H-1B cap foreign graduates of U.S. institutions with masters or PhD degrees.

c. According to some estimates, this proposed exemption would likely result in 30,000 to 40,000 additional H-1B visas per year.

d. This new exemption would amount to a 60% increase in H-1B visas over and above the current 65,000 cap (and many believe this is a low-ball estimate).

e. At a time of mass layoffs, especially in the high-tech field, the H-1B visa program has deeply hurt American high-tech workers.

f. While reforms of the H-1B and L-1 visa programs are desperately needed, exempting any categories from the cap will harm American workers. This is especially true at this time when 14 million Americans can't find a full-time job.

g. While there are many factors responsible for the current desperate situation many American high tech workers face, three years of bloated H-1B visa numbers have contributed significantly to the wage depression and job displacement suffered by many of these workers.

h. Worse yet is that these Members, aware of public opposition to the importation of more foreign workers and the resulting increase in job competition, want to avoid any debate of their plan and sneak it into a "must-pass" bill during the lame duck session of Congress.

i. American workers losing their jobs have no protection against this government sponsored worker replacement program. Any company, once they acquire an H-1B worker, can let an American worker go, no questions asked.

j. American workers have little protection against the H-1B program. It displaces many programmers and depresses wages. Think of the many skilled workers in America today and their inability to find work, coupled with the fact that there are no safeguards against a company firing an American worker and replacing him/her with low cost temporary labor.

k. Once the world learns of this loophole, we can expect to see huge increases of foreign students getting masters degrees in U.S. colleges, knowing that will give them the right to stay and take American jobs regardless of how depressed the market may be for American workers.

3. ACTION..........Georgians, phone your Sen. Chambliss who is champion of this H-1B loophole

Sen. Saxby Chambliss is reported to us as being the prime mover of this terrible affront to the families of American technical workers.

He needs to hear overwhelming disapproval from his Georgia constituents (based on arguments above). He arrived in the Senate saying that the H-1B program was corrupt and needed reforming. Instead, he now is making the corruption worse.

I'm told by our Capitol Hill team that the congressional office of Rep. Smith (R-TX) has been in the thick of pushing this H-1B loophole. Mr. Smith has long been one of the most important leaders in Congress for sensible immigration policies, but he appears to ahve badly misstepped on this. His staff needs to hear what Texans think about this H-1B expansion in the midst of a depression in the tech field.

URGENT: Call your Senator TODAY to oppose an H-1B increase attempt

This is an URGENT REQUEST to everyone concerned about American worker replacement programs and the loss of American jobs to cheaper foreign labor.  Whether or not you are personally working in a high-tech field or have a particular tie or interest with high-tech jobs, ALL AMERICANS must come together and fight this attempt to put more American workers in the unemployment line.  H-1B visas are one of the tools employers use to displace American workers here in the US and to send American jobs overseas.

We have learned that the Senate will hold a meeting at some point on Monday during which they will consider attaching an H-1B increase to an appropriations bill. We do not yet know what time the meeting will occur or what bill they are attempting to attach the increase to.

There is a move underway among some Senators to increase the annual H-1B cap by exempting from the cap foreign nationals holding a Masters degree or higher from a U.S. university.

Please call your Senators immediately and ask them to oppose this increase.

Your message can be as simple as:

"I'm calling to ask Sen. _______ to oppose the move to increase H-1B visas. I know this will be discussed during a Monday Senate meeting."


Because many of you have personal experience with this issue, your calls will be much more effective if you can add something about your personal story.


Senator Stevens is chair of the Senate Appropriations Committee so he will play a special role in determining what measures are allowed to be attached to various spending bills. For that reason, you may also want to call Senator Stevens and let him know that you oppose any increase in H-1B visas and ask him to oppose any effort to attach such an increase to a spending bill.

You must call your representatives and ask them to co-sponsor and support two CRITICAL bills in Congress (H.R.2702, and H.R.2688). The Toll-Free number to the DC-House of Representatives is 800-648-3516. Just ask to be transferred to your Representative.  Then fax them.  Then email them.  Then send them a snail mail letter.  Keep doing this over and over until you get their support.  Do NOT give up!  See the bulleted list of action items below:

H.R. 2702 “L-1 Non Immigration Reform Act”
June 17, 2003:  Rep Rosa DeLauro (CT-D 3rd) introduces H.R. 2702 “L-1 Non Immigration Reform Act”.  We strongly support this legislation which will put a tight clamp on the flood of workers who are not American citizens (and have not applied to be American citizens) from taking jobs from American citizens.  The bill limits L-1s to 35,000 per year.  Today, there is no limit.  L-1s would also not be allowed to work on contract for “third parties”.  There are a number of other protections for American workers including limitations on a company being able to lay off an American worker within plus-or-minus 6 months of an L-1 being hired.  Other provisions also exist which would prevent abuses that are occurring today.

H.R. 2688 “Repeal of Authorities Relating to H-1b Visas for Temporary Workers”
July 9, 2003:  Rep Tom Tancredo (R-CO 6th) introduces H.R. 2688 “Repeal of Authorities Relating to H-1b Visas for Temporary Workers”.  This simple 15-line piece of legislation would completely OUTLAW and END the H-1B visa!  Needless to say – We are VERY PLEASED with the simplicity and forthrightness of this legislation.  This is EXACTLY what we have been fighting for!  Now it is up to us to make it happen.

Note: Prior to the June 17 bill out of Connecticut, Rep. John Mica from Florida introduced legislation concerning the L-1 visa as well.  We DO NOT support that legislation due to a number of loopholes he left in it.  Rep. Mica is primarily funded by large corporations but was also running into media problems with the non-immigrant visa issues due to activism driven by Mike Emmons in Florida.  So to get around this, Mica devised some L-1 legislation with plenty of loopholes.


The Tom Tancredo bill and the Rosa DeLauro bill are BY FAR the best we have seen yet!!!!  BUT – Both representatives need co-sponsors and support for these bills in Congress.  To get those Co-Sponsors and supporters, we need you to do the following:



  • Pass the URL to this page to as many people as you know, and inform them of these bills in Congress.

  • Use the “Write To Congress” button on the first page of our website and find the contact information for your representative.  CALL YOUR Representative to tell them you want them to support the 2 bills above (H.R.2702, and H.R.2688).  The Toll Free number to the House of Representatives in DC is 800-648-3516 ask for your Rep's office. The Toll-Free number to the Senate in DC is 877-762-8762.  Use any and all (legal) methods to get your message to them.  A hand-written letter is best.  A call is second best.  A Fax is next best.  An email is least effective, but is better than nothing at all.  To be safe, do all of them!  [Sample letters]

  • Let us know if you are interested in gathering signatures in your state in support of these bills.  We need ALL the HELP we can get!!!  Remember, these are national in scope.  We cannot pass these alone.  Recruit the help of everyone you can!  We need a constituent (or several) of each member of Congress to organize a signature gathering in their district.
