General

1. The Haaretz computerized site ("the site") makes it possible to access news, articles and reports that have been published in Haaretz newspaper with a broadly liberal outlook both on domestic issues and on international affairs ("the service"). The service offered on the site is subject to and conditional upon users' agreement to these rules.

Use of the site indicates the user's agreement to these rules and to the privacy policy contained herein.

These rules are written in the masculine solely for the sake of convenience and they relate equally to both men and women.

2. In these rules the following expressions shall have the following meanings -

"information" means any material or information that appears on the site in any medium, including text, pictures, illustrations, graphics and it includes the design of the aforegoing;

"the Company" means Haaretz Daily Newspaper Ltd;

"user" means any person, body or entity that enters the site;

"customer" means any user who has applied to purchase information.

Conditions For The Information's Use

3. It is hereby expressed that the right to use the information is personal to the user and he may not permit any third party to use the information for or without consideration.

4. The user undertakes to use the information and the services offered on the site in accordance with the requirements of law and subject to the site's conditions and regulations.

5. The user undertakes not to publish the information or any of it except in accordance with the conditions set out on the site. The user further undertakes not to publish any product or printout of the information, whether printed graphically or as a report, whether provided as a file on magnetic media or howsoever otherwise and not to reproduce, photocopy, copy or print any such product or printout of the information or any of it for the purpose of distribution or publication in any way whatsoever. The user further undertakes not, directly or indirectly, for or without consideration, to permit the performance of all or any of the aforegoing.

6. Any copying, distribution, sending, transmission or publication of information stored on the site that has not been expressly permitted is prohibited unless the Company's prior written consent has been given. 7. The information shall not be used for the purposes of profit or for any other commercial purposes and shall not be stored on other Internet sites.

8. The information shall not be altered, edited or processed.

9. The user undertakes strictly to safeguard the information and to take all precautions necessary to avoid its loss or coming into the possession of another person.

Limitation Of Liability

10. The service is offered to the user"as is" and the Company shall not bear any liability for its suitability for the user's needs or purposes.

11. A range of information is published on the site, including articles, news, maps, tables and various data. The information is presented merely as a service to the user and might be revised from time to time. The Company is not responsible for the content of the information or for any use that is made of it. Before reliance upon any information, it is suggested that the information be independently checked.

12. Information of a commercial character is published on the site from time to time. If the user wishes to use the information he must check and verify it before use. The Company shall not bear any liability for errors in the information, and its publication does not constitute a recommendation or opinion, and any reliance on the information is at the user’s sole risk.

13. The user hereby acknowledges that the Company is not liable for any direct or indirect use of the service that he makes and that he is solely liable for any use of the service that he makes.

14. The user hereby acknowledges that although the Company acts so far as possible for the information to be as correct and accurate as possible, there might be flaws, errors and inaccuracies in the information and the way in which it is transmitted to the user.

15. The information published on the site and the advertisements appearing on it make it possible to refer to other Internet sites. The Company is not howsoever liable for the information appearing on those sites just as it is unable to apprise the nature, quality or reliability of the information on those sites. Any use of the information on those sites is at the user's sole risk.

16. The information published on the site includes information that is published on the site by users. The Company is not liable for the information or views published by users, which are not published on behalf of the Company. The Company shall bear no liability for information, announcements or offers published on the site by users or for any consequence deriving as a result of the use of that information.

17. The Company does not undertake that the use of the information on the site shall not be disrupted or that it shall be provided regularly, without interruptions, securely, without errors or will be free of damage, fault, malfunction or failure.

18. The Company, including its directors, employees and all those acting on its behalf, shall not be liable for any direct or indirect damage caused to the user or any third party by use of the information or its content or by the cancellation or interruption of the service, including because of disruptions or faults in the transmission of the information, whether caused wilfully by any third party or by reason of any malfunction.

Intellectual Property

19. The user acknowledges that the copyright, patents, trade secrets, rights of ownership and/or use in respect of the information, including the distribution rights and all other intellectual property in the information belong to the Company, and the user has no right whatsoever in the information and that the use of the information is solely for the user's personal purposes.

20. Various parts of the information and some of the images appear on the site in accordance with agreements between the Company and third parties. Copyright in that content and/or the images belongs to third parties, which have permitted the Company to make use of them. The information and the images are not to be copied, reproduced, distributed, marketed, used or conveyed to others and no commercial or other use of them is to be made without obtaining the Company's prior written consent.

Privacy Policy

21. At the time of registering for certain site services (hereinafter "the services") you may be asked to complete a registration form which may include certain personal details.

The details that you provide and any other additional particulars that may be supplied ("the registration information") will be stored by the Company in electronic database format in the State of Israel in accordance with such statutes and regulations that pertain to the storage of such registration information. The registration information may be used for such legal purposes as permitted by the laws of the State of Israel.

You are under no obligation to provide the details requested but the Company has the option not provide the relevant service(s) unless you do so.

The Company is permitted to use the registration information given by you when registering for such services in order to make contact with you as and when it may deem appropriate, and to update you from time to time about new site services and special offers and /or additional services offered by the Company or other entities that the company is connected with or does business with.

In addition, the Company is permitted to use the aforesaid registration information for marketing purposes and/or as part of the data that is collected for statistical purposes and/or as part of aggregated statistical data that is passed to a third party on the strict condition that any such registration information that is passed over does not identify any individual user by name or other personal identifying factor.


Termination Of The Contract

22. The Company may block the service without notice insofar as the user has used the services contrary to the law or the provisions of these rules, insofar as the user has not paid the whole use charge on time or for any other reasonable cause.

23. For the avoidance of doubt, it is expressed that the termination of the contract between the parties shall not derogate from any of the user's obligations as provided in this agreement, including payment of the use charge.

Additional Conditions

24. The Company reserves its right to alter the terms and conditions for the use of the site from time to time at its absolute discretion. Any such alteration will obligate users from the moment it is published on the site.

25. The Company may charge payment for the service, provided that the change is published in the tariff tables set out in the archive.

26. It is hereby expressed that only the provisions of these rules will obligate the Company.

27. Exclusive jurisdiction in any matter or dispute relating to the services on the site shall rest with the competent court of Tel Aviv, which shall try the matter in accordance with the laws of the State of Israel.
