The U.S. Supreme Court agreed on December 12, 2005 to hear challenges to the Texas congressional redistricting plan passed in 2003.
Below are links to the documents currently before the Court in this case.
The Court consolidated four appeals from a three-judge federal district court's ruling that had upheld the map against all challenges. The Court held a two-hour oral argument on March 1, 2006, from 1:00 p.m. to 3:00 p.m.
The cases are League of United Latin American Citizens v. Perry, 05-204; Travis County v. Perry, 05-254; Jackson v. Perry, 05-276; and GI Forum of Texas v. Perry, 05-439.
Jenner & Block Partners Paul M. Smith and Sam Hirsch represent the Jackson appellants, a group of Democratic voters and officeholders who allege that the map violates the Constitution because the Texas Legislature redrew a lawful districting plan in the middle of the decade, for the sole purpose of maximizing partisan advantage. The Jackson appellants also contend that the 2003 plan dilutes African-American voting strength in and around Fort Worth, in violation of the Voting Rights Act, and that the map's South Texas districts are excessively race-driven, in violation of the Equal Protection Clause.
