Zuma has received a warm welcome at the Cosatu congress

Justice Herbert Msimang has dismissed the State's application for a postponement of the Jacob Zuma corruption trial, and then struck the matter off the roll.

Giving judgement in the Pieternaritzburg High Court, the judge said the state's effort to prosecute was from the start "anchored on unsound foundations".

He referred to the fact they wanted to prosecute, knowing they did not have a final indictment. After its application for a postponement was dismissed, the State indicated it wasn't ready to proceed. The matter was then struck off the roll.

Supporters of Zuma broke out in song and dance outside the court on hearing the news. Zuma is expected to address them shortly.

Makhosini Nkosi, the National Prosecuting Authority spokesperson, has expressed disappointment with the ruling. Addressing the media outside the court, Nkosi said this was not necessarily the end as consultations will be held to determine if charges can be brought against the former deputy president with a final indictment.

Reaction from unionists
The 3000 delegates at Cosatu's congress in Midrand erupted with song and dance as Zwelinzima Vavi, the Cosatu general secretary, announced the news from the Zuma trial. Blade Nzimande, the SACP leader, says should the State bring fresh charges against the ANC deputy president, this process needs to be credible.
