Supreme Court Swerves Hard Right in First Term with Roberts and Alito
Supreme CourtChief Justice Roberts and Justice Alito just completed their first term together—one marked by disastrous decisions undermining our rights and liberties. They joined with Justices Scalia, Thomas, and Kennedy to issue reactionary rulings on pay discrimination, reproductive rights, school integration, church-state separation, and more. Read our report.
The Supreme Court Misinterpreted the Law
Lilly LedbetterIn a 5-4 decision, the Supreme Court ruled against Lilly Ledbetter, and made it harder for victims of wage discrimination to seek justice through the courts. In her vigorous dissent, Justice Ginsburg wrote, "The ball is in Congress' court." And now it’s in yours: Urge Congress to correct the Court!
After Republican Delays, a Dusturbing Judicial Nominee Slips Through
Leslie SouthwickJudiciary Committee Republicans and Senator Dianne Feinstein voted to advance Leslie Southwick's nomination to the full Senate. That's not why Americans voted to give Democrats their majority in the Senate, which must reject Southwick and insist that the President find someone who will interpret the law fairly for all Americans.
Bush Administration Extremism on Access to Courts Gets No Takers on Supreme Court
The Bush administration has repeatedly staked out extreme positions that would slam the courthouse door to ordinary Americans who turn to the federal courts to protect their constitutional rights. The administration’s most recent push to institutionalize its anti-access ideology was rebuffed today even by the rightward-running Supreme Court.
GOP Presidential Candidates Pledge Far-Right Supreme Court in Bid for Base Voters
SCOTUS?Republican presidential candidates, many with personal or political records that raise questions among Radical Right leaders and base voters, are hoping that pledges to appoint far-right Supreme Court justices will overcome those doubts. Early promises to appoint additional justices in the mold of Antonin Scalia and Samuel Alito should be a red flag to Americans concerned about the future of the Court and the Constitution.
Republicans Complain About Stalled Nomination, Forget About Stalled Docs
Peter KeislerThe letter of the nine Senate Judiciary Committee Republicans to Committee Chairman Leahy asks whether "there is anything we can do" to push consideration of Peter Keisler's nomination to the DC Circuit. Here's one thing: How about demanding that President Bush release all of the Keisler records now bottled up in the Reagan Library?
Supreme Court Rebuffs Bush Administration on Global Warming
A sharply divided Supreme Court ruled 5-4 that the Environmental Protection Agency has the authority under the Clean Air Act to regulate the emissions of carbon dioxide and other heat-trapping gases from new automobiles. The EPA claimed that it did not have the authority to regulate greenhouse gas emissions from new cars, but that even it did, it would not act at this time because to do so would conflict with other priorities of the Bush administration.
D.C. Circuit Nominee Keisler Accused of Undermining Government Tobacco Case
Disturbing allegations have come to light that Peter Keisler—a co-founder of the Federalist Society and currently a nominee to the D.C. Circuit Court of Appeals—was involved in applying inappropriate political influence in the government's case against the tobacco industry.
Bush Judges Confirm Opponents' Fears
Federal appeals court judges nominated by President Bush are threatening and undermining Americans’ rights and liberties, and working to reduce congressional authority to protect those rights and liberties, according to a legal analysis published today by People For the American Way Foundation.
