Introduction

The sigames.com web site and service available at http://www.sigames.com ("sigames.com") is an online service run and owned by Sports Interactive Limited ("Sports Interactive") to provide information and services relating to the series of games developed by Sports Interactive including without limitation Football Manager 2005 and Eastside Hockey manager (“Games”).

These terms and conditions ("Terms") apply to all and any use of sigames.com and all and any postings, emails and other communications made to or using it or any forum, facility or service run by Sports Interactive or any other party through sigames.com ("Submissions").

By using sigames.com you agree to be bound by these Terms.

If you do not accept these Terms you should not use sigames.com or make any Submissions.

Sports Interactive may make alterations to these terms and conditions from time to time and these variations shall become effective immediately upon being accessible from http://www.sigames.com/terms.php.

sigames.com is principally aimed at the UK and EU markets and no guarantee can be given that the information and services available accord with local laws of any other countries.

Copyright and Trade Marks

All copyright, design rights, database right, patents, and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any applications therefor ("Intellectual Property Rights") in sigames.com belong to and vest in Sports Interactive, or are licensed to Sports Interactive, including in the design, layout, look and feel, graphics and images unless otherwise specified. All such rights of Sports Interactive are hereby asserted and reserved.

All Intellectual Property Rights in the Games including without limitation all software, design, look and feel, characters, rules, gameplay, features and characteristics belong to and vest in Sports Interactive or its licensors and are licensed for publication throughout the world to Sega Europe Limited. Such may not be used in any way except with appropriate prior written consent or as prescribed in the license terms for such games.

All Intellectual Property Rights in the database of football teams, players, players’ details, managers, stadia, competitions, nations, and other football related statistics created by Sports Interactive and contained in the Games and other games developed by it belong to and vest in Sports Interactive and may not be used in any way except with its prior written consent or as prescribed in the license terms for such games.

Football Manager, Football Manager 2005 and the Football Manager logo are trade marks or registered trade marks of Sports Interactive in the United Kingdom and/or other countries. Sega and the Sega logo are trade marks or registered trade marks of Sega in the United Kingdom, United States and/or other countries. Eidos and Championship Manager are trade marks or registered trade marks of Eidos Interactive Limited in the United Kingdom and/or other countries. All other trade marks are the property of their respective owners and Sports Interactive makes no warranty or representation in respect of any trade mark.

Use of sigames.com and Games (in addition to Games License Terms)

Sports Interactive hereby grants you a personal, non-exclusive, non-transferable and non-assignable license to use and display, for home, non-commercial and personal use only, this sigames.com site, including the files, codes, audio or images incorporated in or generated by it, its software and the information contained on or in sigames.com (“Downloaded Content”) but not including any patches for any games developed by Sports Interactive which shall be subject to the license terms of such game or games. Commercial use, reproduction, distribution or transmission of any part or parts of sigames.com or any information contained therein by any means whatsoever without the prior written permission of Sports Interactive is not permitted.

You must include or maintain all copyright and other notices contained or associated with the Downloaded Content.

You may not without the prior written consent of Sports Interactive and where appropriate its Licensees:

distribute, modify, transmit, re-use, re-post, or use the Downloaded Content or any of sigames.com for any purpose other than as set out above nor for public or commercial purposes;
provide hypertext links, URL Links, graphic links, hyperlinks or other direct connection for profit or gain to sigames.com or the Downloaded Content;
display, publish, copy, print, post or otherwise use sigames.com or the Downloaded Content or any or all of for the benefit of any other web site;
process or otherwise use sigames.com or the Downloaded Content for any illegal or immoral purpose nor use or process the same unfairly;
sublicense, assign or otherwise transfer this license or the Downloaded Content and no title to the Downloaded Content has been or will be transferred to you from Sports Interactive or anyone else;
alter, disassemble, decompile, reverse engineer or otherwise modify the Downloaded Content or sigames.com;
use any Sports Interactive materials or any materials contained in any Games on any other web sites.

In the event that any consent is given, you must include all copyright, trade mark and other notices as appropriate.

Consent will not be given by Sports Interactive at its discretion but in particular in relation to any web site that features unlawful, racist, defamatory, pornographic, inflammatory, or other legally restricted content, including, but not limited to, hacks for any Sports Interactive developed games including the Games or any other content that Sports Interactive find objectionable or unlawful.

Exceptional use of the Downloaded Content, sigames.com and the Games shall be permitted as follows:

If you wish to review the Games, you may do so and use only such elements and screen shots as is fair and reasonable provided that such is accompanied by sufficient and appropriate acknowledgement of Sports Interactive and it licensees as appropriate.
If you run a web site or similar service supporting, promoting or acting as a community where fans and players of the Games may interact, you may:
- use selected screen shots of a game as is fair and reasonable for review provided that such is accompanied by sufficient and appropriate acknowledgement of Sports Interactive.
- undertake non-commercial mirroring of patches, downloads and demos, so long as you do not alter the patches or demos in any way and all files included with the original patch or demo are present and intact;
- provide a reasonable graphical hypertext link to the home page of sigames.com accompanied by sufficient and appropriate acknowledgement of Sports Interactive.

You may not mirror or translate sigames.com or any Games into another language without written permission from Sports Interactive and, where appropriate, its licensees.

Sports Interactive and its licensees:

reserve the right to refuse permission to host or distribute patches and demos to anyone, for any reason, at any time;
prohibit the sale or other commercial exploitation of any CD or other media containing patches, add-ons or mods found on the Internet or otherwise for any Games without prior written consent;
do not permit, authorise, support or condone the use or distribution of unofficial cheats and/or hacks for use with any Games;
do not support or condone network/internet play of the Games except as specifically provided by the particular Games. Specifically, you may not host or provide matchmaking services for any of Games or emulate or redirect the communication protocols used by Sports Interactive or in the network feature of its games, through protocol emulation, tunnelling, modifying or adding components to the game(s), use of a utility program or any other techniques now known or hereafter developed, for any purpose including, but not limited to network play over the Internet, network play utilising commercial or non-commercial gaming networks or as part of content aggregation networks without the prior written consent of Sports Interactive;

Sports Interactive reserve the right to revoke this limited use license at any time, for any reason and at the sole discretion of Sports Interactive.

Disclaimers and Liability

Sports Interactive shall have no liability in respect of any other web site or page on the Internet accessible from sigames.com or any other web site. Third party web sites with links from sigames.com have not been verified or reviewed by Sports Interactive and are not endorsed by it. Use and access of such is made at your own risk.

Sports Interactive provides and maintains sigames.com and the Downloaded Content for personal entertainment and information about the Games and its business free of charge and on an as is basis.

Sports Interactive shall be liable only to provide sigames.com and the Downloaded Content with reasonable skill and care and gives no other warranty in connection with sigames.com.

Subject as aforesaid, to the maximum extent permitted by law, Sports Interactive excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect, punitive or consequential loss whether or not such arises out of any problem you notify to Sports Interactive and Sports Interactive shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

any incorrect or inaccurate information on sigames.com or in the Downloaded Content and all interruptions to or delays in updating the service;
the infringement by any person of any Intellectual Property Rights of any third party caused by their use of sigames.com or the Downloaded Content;
any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or sigames.com or the Downloaded Content, or from transmissions via emails or attachments received from Sports Interactive or its licensees;
all representations, warranties, conditions and other terms which but for this notice would have effect.

Your statutory rights as a consumer are available to you and these terms shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall it exclude or limit Sports Interactive's liability for death or personal injury resulting from its negligence nor any fraudulent act.

Privacy Policy

From time to time Sports Interactive may ask for and / or you may choose to submit personal data to sigames.com or Sports Interactive (including your name, phone number, postal address, email address and other contact details) as part of your use of the forums, for making Submissions or for purposes of identification and marketing,

Sports Interactive may also use cookies (code by which information relating to your internet activity such as whether you have visited sigames.com before is recorded and used) to: (a) record which Games and sections of the sigames.com web site you are interested in; (b) which Downloaded Content you access; and (c) otherwise monitor customer traffic patterns and site use.

All information we obtain will be kept securely in accordance with our internal security policy and may be used to: (a) provide you with an up to date, efficient, and reliable service; (b) open and run a forum account; (c) administer prize draws; (d) enable Sports Interactive to improve sigames.com generally.

If you do not wish for us to use cookies when you use sigames.com please adjust your Internet browser settings to not accept cookies. Your computer’s help file should tell you how to do this. Alternatively, please check the box marked “please do not use cookies.”

If you do not want Sports Interactive to collect or process your personal data, please do not submit it and if you have or you believe that we have data about you that is incorrect please write to Sports Interactive at the address below and the information will be corrected as soon as possible or removed from our database as you request.

Sports Interactive makes a commitment to protecting your privacy and promises only to use information collected about you in accordance with the Data Protection Act 1998.

From time to time we also monitor and record telephone calls for training purposes and to improve the service to you.

We will never collect sensitive information about you without your explicit consent.

If you have used sigames.com before it is possible that we have this information already and it is being used to contact you about offers, events, items or related activities that you may find useful. If you are an existing user / customer we will continue to keep you informed unless you tell us not to.

If you are a new user / customer you have the choice whether or not you want us or other reputable companies to contact you about our Games, offers, events and / or related activities that you may find useful. We will not bombard you with emails and we do not sell, trade or rent your personal information to other companies but we’d like to keep you informed or what is going on and we may want to share data with other reputable companies (within and outside the European Union) who may have interesting offers and information for you.

Sports Interactive will not send you any marketing emails or pass your information on to third parties unless you give us your consent, unless we have already your contact details already.

Where requested please therefore check the relevant box marked:

“I would like to receive information from Sports Interactive in future” if you wish to receive future information from Sports Interactive;
I would like to receive information from interesting third parties” if you want us to pass the information on to third parties.

Your Privacy

If you have any questions or comments about privacy or the Sports Interactive privacy policy, or if you already have submitted information that you do not wish us to have or if you think that Sports Interactive has cookies or data about you that you don’t want us to use or that is incorrect please contact us at info@sigames.com or by post to Postmaster, Sports Interactive Limited, PO Box 60255 London, EC1P 1GG and the information will be corrected as soon as possible or removed from our database as you request.
Sports Interactive is registered with the Information Commissioner in accordance with the Data Protection Act 1998.
Community and Forum
Sports Interactive runs a forum for the exchange of views relating to Games and other issues on sigames.com and for fans and players of these games and other products and services developed by Sports Interactive to interact. As such it is a mere conduit engaged in the business of providing a communication, entertainment and information service and is engaged in the transmission, storage, retrieval, hosting, formatting or translation of third party communications without selection or alteration of the content of the communication.
You agree and accept that Sports Interactive has no responsibility to review the content of any Submissions (as defined above) on sigames.com which (and each forum, facility or service with in it) is made available on the basis that Sports Interactive shall not be required to exercise any control or judgement of the content or the material posted or contained therein.
The views expressed in any Submissions are the views of the individual contributors and not those of Sports Interactive unless specified otherwise by Sports Interactive.
In particular but without limitation to the above Sports Interactive is not responsible for and disclaims all liability in respect of any comments, views or remarks expressed in any Submissions.
Sports Interactive gives no warranty and makes no representation as to the accuracy, currency or validity of the information and material contained within the Submissions or sigames.com and shall not be responsible for any loss or damage caused as a result of any use of such material.
You agree and undertake that you will not post or transmit to, through or using sigames.com any statement, material or Submission that:
- is unlawful or which gives rise to civil or criminal liability;
- is technically harmful such as computer viruses, worms, logic bombs or other malicious software or harmful data;
- is defamatory, libellous, untrue, discriminatory, obscene, inflammatory abusive or racist in any way whatsoever;
- infringes any intellectual property right of any person including without limitation any copyright, trade mark, patent right design right, database right, performance rights or personality or image rights.
Sports Interactive has the absolute right to remove any Submissions it deems unacceptable
You agree to indemnify and hold harmless Sports Interactive against all liability it may have in respect of and arising out of your use of sigames.com and your Submissions.
Termination
Sports Interactive shall be entitled to terminate any licence granted by these Terms and immediately remove, cancel or suspend access to and use of sigames.com upon your breach of any part of these Terms whatsoever.
Termination shall be without prejudice to any accrued rights.
Sports Interactive will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen contingency beyond the reasonable control of such party including without limitation Internet outages, communications outages, fire, flood, war or act of God.
General
Except as provided above there are no warranties, conditions or other terms, express or implied, statutory or otherwise given by Sports Interactive and all such terms are hereby excluded to the maximum extent permitted by law (but subject to your statutory and common law consumer rights).

Sports Interactive acts as principal on its own account and not as agent for you or any other person.
If Sports Interactive does not enforce any provision of these Terms such will not be considered a waiver of any provision or right.
In the event that any part of these terms and conditions is held to be unenforceable, such part will at Sports Interactive's option be construed as far as possible to reflect the parties' intentions and the remainder of the provisions will remain in full force and effect.
These Terms shall apply to the exclusion of all other terms or conditions of contract which you may purport to propose.
Use of sigames.com and these Terms are subject to the laws of England, which shall exclusively govern the interpretation, application and effect of these Terms and shall be construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.
