European Patent Litigation Agreement (EPLA)

"Draft Agreement on the Establishment of a European Patent Litigation System" and "Draft Statute of the European Patent Court".

A drafting committee of the EPO transferred the finalized "Third Proposal for an EPLP" into treaty language. The organization of the court and the procedure have been separated and drafted into two separate proposals. The term "European Patent Litigation Protocol (EPLP)" was replaced by "European Patent Litigation Agreement (EPLA)" for reasons of international law. The first two drafts were discussed at the 6th meeting of the Sub-group of the Working Party on Litigation and are now available in finalized versions. The proposals will be submitted by the Sub-group for opinion at the upcoming meeting of the Working Party on Litigation (December 3 - 5). The meeting will be chaired by Switzerland (draft EPLA, pdf 161 KB and draft Statute, pdf 84 KB).
