The basic step in preparing an estate plan are for you (and your spouse) to pray over several key decisions and review the following:

  1. Your assets and how they are titled.
  2. Your personal and family situation, including any special needs that may effect your plan.
  3. Family, friends, and organizations you wish to receive shares of your estate.
  4. The person(s) you wish to nominate as your executor and/or trustee. In addition, if you have minor children, decide who you wish to be their guardian. You will want to select an alternate for all nominees.

With this general information in hand, you are ready to consult with an attorney to develop your estate plan.

In cases when assets and family situations are simple, an attorney may advise that a will is sufficient. While in other cases, involving abundant or complex assets and/or multiple marriages, a more sophisticated estate plan may be required.
