Terms of service
Please read this agreement carefully. These Terms of service are a binding contract between you and Opera Software ASA (“Opera”). By using the Web site and/or Opera's services you hereby agree to be bound by these Terms of service. Otherwise, please discontinue the use of this Web site and/or Opera Service(s).
Opera provides users with access to numerous services, including without limitation, the My Opera Web site, the Opera Portal Web site, Opera Unite, the Dev.Opera forum, the Opera Widgets Web site, search services, personalized content and branded programming through its network of properties, which may be accessed through any various medium or device now known or hereafter developed (the “Services”).
In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms. You can accept the Terms by either clicking to accept or agree to the Terms, where this option is made available to you by Opera; or by actually using the Services. In this case, you understand and agree that Opera will treat your use of the Services as acceptance of the Terms from that point onwards.
Certain features of these Services may allow you to post or send content that can be viewed by others ("User Generated Content"). You agree that we are not liable for User Generated Content that is provided by others. We have no duty to pre-screen User Generated Content, but we have the right to refuse to post, edit, or deliver submitted User Generated Content. We reserve the right to remove User Generated Content for any reason, but we are not responsible for any failure or delay in removing such material. We reserve the right to block any user's access to any content, web site or web page in our sole discretion.
By using the Services, you warrant that you will not upload, transfer or otherwise make available files, images, code, materials, or other information or content ("Content") that is obscene, vulgar, sexually-oriented, hateful, threatening, or that violates any laws or third-party rights, hereunder, but not limited to, third-party intellectual property rights. Opera Software strictly forbids unsolicited messaging and unauthorized advertisements while using any Opera service.
You also warrant that you hold all the necessary rights to upload to Opera’s site or another site designated by Opera, including the necessary consent to upload and distribute any personal information about third persons and that you will not upload viruses or other forms of malware.
We do not claim ownership of any User Generated Content. However, by submitting User Generated Content to us, you grant us the right and limited license to use, copy, display, perform, distribute and adapt this User Generated Content for the purpose of carrying out the Services.
Opera is free to use ideas, concepts, know-how, or techniques that is submitted to Opera Software in the Dev.Opera forum.
Disputes may arise between you and others or between you and Opera Software ASA related to content, including User Generated Content. Such disputes could involve, among other things, the use or misuse of domain names; the infringement of copyrights, trademarks or other rights in intellectual property; defamation; fraud; the use or misuse of information; and problems with online auction or commerce transactions. You agree that all claims, disputes or wrongdoing that result from, or are related in any way to, the content of information that you post, transmit, re-transmit or receive through the Services, Opera Software's network or Software are your sole and exclusive responsibility. Opera Software ASA may at its discretion block certain web sites or domains and re-route you to other pages. By accepting these Terms of Use, you hereby consent to this.
By accepting the Terms of service, you acknowledge that you have read, understood, and accepted these Terms, as well as Opera’s Privacy policy, which is available at http://my.opera.com/community/privacy/. Please take the time to read Opera’s Privacy policy, as it informs you of which information Opera collects and how it is used.
The Services contain (or you may be sent through the Opera’s site or the Service) links to other Web sites ("Third- Party Sites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (the "Third-Party Applications, Software or Content"). Neither the Services nor Third-Party Sites nor Third-Party Applications, Software, or Content are investigated, monitored, or checked for accuracy, appropriateness, or completeness by Opera. Furthermore, we are not responsible for your use of the Services or any Third-Party Sites accessed through the Site or any Third-Party Applications, Software, or Content posted on, available through, or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Sites or the Third-Party Applications, Software, or Content. Inclusion of, linking to, or permitting the use or installation of any Third Party Site or any Third Party Applications, Software, or Content does not imply approval or endorsement thereof by us.
If you decide to leave the Site and access the Third-Party Sites or to use or install any Third Party Applications, Software, or Content, you do so at your own risk, and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from the Site or relating to any applications you use or install from the site.
Opera will not be liable to you for any scheduled or nonscheduled interruptions of the Services.
You expressly acknowledge and agree that use of the software is at your own risk and that the software is provided “AS IS” without any warranties or conditions whatsoever. Opera Software ASA or its suppliers do not warrant that the operation of the software will be uninterrupted or error free. You assume responsibility for selecting the software to achieve your intended results and for the use and the results obtained from the software.
In no event shall Opera Software ASA or its suppliers be liable for any indirect, incidental, special, or consequential damages or for any damages whatsoever (including, but not limited to, damages for loss of business profits, business interruption, loss of business information, personal injury, loss of data, loss of privacy, or other pecuniary or other loss whatsoever) arising out of the use or inability to use the software, even if advised of the possibility of such damages. Opera highly recommends that you back up the files on your hard disk regularly.
These Terms, as well as the Privacy policy, may be modified by Opera Software without notice at any time in the future. Changes will be posted at http://my.opera.com/community/terms-of-service/. It is the responsibility of all users to remain informed of any changes at all times, as all users are bound by the latest version of the Terms and Privacy policy.
