This guy has taken-on Jay-Z, legally speaking, so his fight against the musical act 3Oh!3 should be a no-brainer. You know the “diamond hand symbol” that’s associated with all of the illuminati theories, the one that is often associated with Jigga and a bunch of other celebs?

This one:

Total Life Prosperity

Who would have thought that this symbol was already trademarked, by someone OTHER than Jay-Z himself???? According to a lawsuit filed today, with U.S. District Court in Los Angeles, “Diamond” Dallas Page owns the trademark, and has filed suit against 3oh!3,LLC for unauthorized use of the diamond cutter trademark.

This guy is not messing around. Apparently, Mr. Page (pka Dallas Page) has been using this symbol since way before the current offenders. Page is a former wrestler, who has also appeared in twelve feature films,  a bunch of videos, and a gaggle of TV shows.

The complaint, obtained by OMG staff, claims that defendants 3Oh!3 have “misappropriated Plaintiff’s Diamond Cutter trademark hand sign to promote its apparel, entertainment services, and other products.” Page asserts that defendants knew of his ownership, but didn’t give a crap, and still use the hand symbol to benefit them. He us suing for trademark infringement, as well as unjust enrichment.

Page wants the court to declare that the defendants have violated trademark law, order 3Oh!2 to stop the infringement, account for all damages they made as a result of using Page’s trademarked hand symbol, and he wants  punitive as well as treble damages (treble=actual damages x3), plus the usual costs attorneys’ fees.

Ummm…so, if you’re out there making the diamond cutter hand symbol, especially as a public figure, you might want to think twice because Dallas Page does not play!

I think what Page really wants is dinero, because the suit against Jay-Z ended with Jay paying Page an undisclosed amount, with Page dropping the lawsuit, and both men having the right to flash the diamond.

What do you think? Should 3Oh3! have to pay Dallas Page?

  1. Imma trademark the middle finger and SUE everyone that uses it!! Watch out.

That's just retarded and I doubt he's suffering much damages, if any. That guy's just greedy..

  5. This is America jack you know what that means? It means you can sue anybody for anything.

By Joe on August 31, 2010 at 9:14 pm

  6. It is called the law. There is a reason for trademark laws and those who make use of them place themselves in a position to sue if their trademark is infringed upon. That is not greedy, that is smart business. Get ready to feel the…BANG!

By Takeshi on August 31, 2010 at 9:25 pm

  7. Diamond Dallas Page was using the Diamond Cutter Sign before the boys in 3OH!3's nuts even dropped down in their sack! He owns the Diamond Cutter….Plain and Simple…It's Business…..Next question!

  8. DDP is the man,,,,, 3hop should feel the cutter as it was meant to be felt and droppe don his dumb ass,,,,,,,

By D ABERNATHY on August 31, 2010 at 11:06 pm

  9. In another context i might agree that this type of lawsuit has no merit however in this case (that is what law is about, particular contexts) DDP really did take this hand symbol and turn it into a bonafide commercial logo, symbol and entity. Did he invent it, probably not, but Apple didn't invent the apple and i dare any one out there to try to use it as a corporate symbol or logo. The DDP character is a business and the diamond cutter hand sign is the verifiable symbol of that business and has been for approximately 20 years, as any wrestling fan knows…This is NOT DDP being foolish or greedy. He is simply protecting his business identity just as any other business would do. He has every right to that identity and unfortunately for 3OH!3, THEY HAVE NO RIGHT TO IT…As they say, 3OH!3 doesn't have a leg to stand on….Guess it's time for the take down!!!

    1. VERY well said. To some this might seem like a small thing but he uses the symbol on everything. When you have a trademark that is being infringed upon you don't just "let things slide" you have to protect it.

By Robert on September 1, 2010 at 10:57 am

  10. Only in america stupid shit like this happens.

By jesus... on September 1, 2010 at 7:30 am

  11. Really Database & Joe? Really? Do you know anything business? Data if I try to use the middle finger for commercial / business purposes and you owned that symbol I could get sued. It's the law… they have no right to it… Tony P is absolutely right…

  12. Another exclusive that is only a lawlsuit that no one cares about.

By Nova on September 1, 2010 at 8:50 am

  13. Can't believe JayZ thinks he can do anything he wants. JayZ be a man and step away, stop being a copy cat and make up your own sign. You are not creative at all. Let Dallas Page have his own & respect him. Step up big shot and pay Dallas

  14. Wow.. can't think of any good reason for that deletion, with all the stuff up here that needs it.

    By @rmclearren on September 1, 2010 at 12:14 pm

  15. I dunno…if you look at the video (My First Kiss) and the album cover, that looks more like they're making a circle than his "diamond cutter" shape…or does DDP own all index finger/thumb combinations? :)

By Casey on September 1, 2010 at 12:33 pm

  16. The 3oh!3 sign is with an O not a diamond. This guy doesn't have a chance.

  18. Honestly I never knew anyone trademarked that symbol. I never even hear of Dallas Page. Why is this in the news? If Dallas has it trademarked, then it's an open an shut case. Dallas wins. You know you live in America when people sue of a hand sign. People need to stop being so sue happy and make money another way.

By Karma on September 1, 2010 at 1:23 pm

    1. you're absolutely right, this is America and we should be able to steal anything we want!!

By larry on September 1, 2010 at 4:09 pm

  19. ddp just sued 3o3 and they are about to feel the bang!!!

By dill on September 1, 2010 at 7:40 pm

  20. I agree with Tony P. Try using the Dallas Cowboys Star logo, or the Bostin Red Sox logo. How abput the NASCAR color band logo ? Heck, use any professional sports logo with out permission . See how far you get . Served with papers & summoned to court . I know DDP won't go down with out a good fight .I'm sure he'll win .

  22. 30h2! ???

    By @ahngiee on September 2, 2010 at 9:37 am

  23. I have a serious problem with these people who say that this is silly. Dallas worked very hard to create a recognizable icon for his name… Trust me.. I know! After the last incident with this I was sure that these guys would just get it.. For as long as I can remember I have known the diamond cutter… I grew up with it… Since he is my dad in all. So if anyone could argue the fact that it is ok "to steal" someone else's hard work.. You are not a person I would like to know. It's a dog eat dog world… And if you are not willing to fight for what you think is right.. You should probably reevaluate the priorities in your life

By Dallas's lil Girl on September 2, 2010 at 12:56 pm

  24. I have known Dallas since he was 3X World Champion in the WCW. He created the diamond cutter sign while in the ring and has a current legal trademark. So do not do the crime if you can not do the time or pay the fine. One may not agree with the law but one must still follow it. This is business–Dallas Page's business!

  25. Wow, I too can't believe what I just typed got deleted. There was nothing bad, but oh well.
