Additional Terms of Service |
1. THE SERVICE |
|
Yahoo! Sports College Broadcast (the "Service"), owned and operated by
Yahoo! Inc. ("Yahoo!"), is a service through which registered Yahoo! users
in the United States only can access certain streaming news and sports audio
and video content for a fee. In order to stream content in the Service, you
must have the minimum system requirements at

2. ACCEPTANCE OF YAHOO! TERMS |

The Service is provided to you under the terms and conditions of these
Yahoo! Sports College Broadcast Terms of Service ("Additional Terms") that
supplement the Yahoo! Terms of Service ("TOS") located at
http://docs.yahoo.com/info/terms/ which is incorporated by reference. For
clarity, the Yahoo! Sports College Broadcast service is a "Service" as
defined in the Yahoo! Terms of Service. Further, the content made available
through the Yahoo! Sports College Broadcast and any client software required
to operate Yahoo! Sports College Broadcast may have their own terms and
conditions governing their use to which you agree to comply. Yahoo! reserves
the right to update and change, from time to time, these Additional Terms
and all documents incorporated by reference. You can always find the most
recent version of these Additional Terms at
http://sports.yahoo.com/s/collegebroadcast-atos and the most recent versions
of the Yahoo! Terms of Service at the URL listed above.

3. YAHOO! ID AND CREDIT CARD REQUIREMENT
|
|
To participate in the Service, you must have a valid Yahoo! ID. You will
also be required to use either a Yahoo! Wallet or Express Checkout, both of
which will save your credit card, billing and shipping information and other
information (collectively your "Registration Data"). If you do not have a
Yahoo! ID you will be prompted to complete the registration process. You
agree and represent that your Registration Data and any other information
you provide is, and will be kept, valid, accurate, current and complete. |
4. PAYMENT TERMS |
|
The credit card that you provide as part of your Registration Data will be
automatically and immediately charged the then-current fee. All fees are
non-refundable and non-creditable. All currency references are in U.S.
dollars. Please note: If you have received a free offer for a specific
number of days, then you will not be charged for the first time until after
your free time period has ended. Subsequent billing dates will be on the
anniversary date of your first billing date. Free trials are available to
new customers only. |
5. TERM AND TERMINATON

5.1. Term and Automatic
Renewal
The subscription to the Service is provided on either (i) a pre-pay month-to-month basis or (ii) a pre-pay school year basis, commencing on the date that you sign up for the Service. The monthly subscription to the Service will automatically be renewed on the anniversary of that sign-up date each month, unless you cancel the Service in accordance with Section 5.2 below. The annual subscription to the Service will not automatically renew and will terminate at the end of the relevant school year.

5.2 Cancellation |
|
You can cancel your subscription at any time by going to http://ordering.yahoo.com/ and
follow the steps to cancel. However, cancellation of the Service
prior to end of the pre-paid month or year will not take effect
until the end of that term and you will not receive a refund. During
that time you will continue to have access to the Service until the
conclusion of that particular term of your subscription. For
example, if you have a monthly subscription and you cancel ten (10)
days after your credit card has been billed for the Service for a
particular month, you will continue to have access to the Service
for the remaining twenty (20) days of the term and the cancellation
will only be effective at the end of the term.

5.3 Termination |
|
If (a) your credit card is invalid for any reason, (b) you charge back to
your credit card the fees due under these Additional Terms, (c) it appears
you have engaged in manipulation of the Service, or (d) Yahoo! otherwise
believes you have acted inconsistently with the spirit or letter of the TOS
or these Additional Terms, your Service account will be suspended or
cancelled immediately and all the information contained within it will
immediately become inaccessible. Yahoo! may, but has no duty to, immediately
terminate the Service if Yahoo! in its sole discretion concludes that you
have provided false information. Yahoo! accepts no liability for information
that is deleted due to termination. |
6. COMMUNICATIONS |
|
As part of the Service, you agree to receive the first of an ongoing series of product update communications related to the Service ("College Broadcast Product Updates"). College Broadcast Product Updates may include information about changes in school availability, special game coverage, and newly added content, in addition to other related products and services. Upon receipt of this first College Broadcast Product Update, you will have the opportunity to opt-out of future College Broadcast Product Updates by clicking on unsubscribe links or by following unsubscribe instructions within the communication. Please note that you may also visit your Yahoo! Marketing Preferences page at any time to manage your communication preferences for other optional communication categories. |
7. YAHOO'S RESERVATION OF RIGHTS |
|
Yahoo! expressly reserves the right to immediately modify, suspend or
terminate your account and refuse current or future use of any Yahoo!
service, including the Service, if Yahoo! becomes aware of information
indicating a safety concern for you, other Yahoo! users, the general public,
or if Yahoo!, in its sole discretion, believes you have: (a) violated or
tried to violate the rights of others; (b) failed to provide or maintain
valid, accurate, current and complete Registration Data or other
information, (c) disclosed your Yahoo! ID, password, other information, or
used your account to enable access to the Service for anyone other than
yourself, or (d) acted inconsistently with the spirit or letter of the TOS
or these Additional Terms. The Service and its benefits are offered at the
discretion of Yahoo!, and Yahoo! has the right to modify or discontinue,
temporarily or permanently, the Service, in whole or in part for any reason,
at its sole discretion, with or without notice to you. You agree that Yahoo!
will not be liable to you or any third party for any modifications or
discontinuance of the Service. |
8. INVALIDITY OF SPECIFIC TERMS |
|
If any provision of these Additional Terms or any document incorporated by
reference is found by a court of competent jurisdiction to be invalid, the
parties nevertheless agree that the court should endeavor to give effect to
the parties' intentions as reflected in the provision, and the other
provisions of the such documents remain in full force and effect. |
9. LOCATION OF LAWSUIT |
|
The Yahoo! Terms of Service, which apply to your Service provides that both
you and Yahoo! agree to submit to the personal and exclusive jurisdiction of
the courts located within the county of Santa Clara, California. The Yahoo!
Terms of Service, these Additional Terms and the relationship between you
and Yahoo! will be governed by the laws of the State of California, without
regard to the conflicts of law provisions thereof. | |
