Weiner 'can't say with certitude' that lewd photo isn't of him

UPDATED AT 4:30 PM ET WITH A REPORT FROM ANOTHER WEINER PRESS CONFERENCE. Weiner attempts a joke, saying he regrets being a little "stiff" with reporters yesterday.

Rep. Anthony Weiner (D-NY) said Wednesday that he can’t say “with certitude” whether or not a lewd below-the-belt photo depicted his body, but he insisted that he did not tweet the picture to a  21-year old college student in Seattle, Wash.

In an interview with NBC’s Luke Russert, Weiner repeated his claim that his Twitter account was hacked and said that he has hired a private security firm to investigate the matter.  

“I was the victim of a prank,” Weiner said.

Weiner sat down with NBC News a day after a testy exchange with reporters on Capitol Hill. He said Wednesday that he was “frustrated” with media coverage of the Twitter dustup but that questions about the issue are fair and reasonable.

But, he added, the controversy should be placed in context.

“This is not a national security matter. We are not making a federal case out of this and I don’t think anyone else should,” he said in explaining his decision not to pursue an independent investigation led by Capitol Police.

The New York congressman also repeated his assertion that he did not know the woman who received the photo over the weekend.

Asked why he follows less than 200 Twitter users – some who are young women unconnected to the political world – Weiner said that his selection of who to engage with on the site is “fairly random.”

He is often asked by Twitter users to “follow” him back on the network, he said, and he sometimes obliges.

“I’m not sure that there’s anything more here than just a little bit of silliness, and I'm going to try to brush it off my shoulder,”  he said. 

*** UPDATE *** NBC's Libby Leist reports... In a press gaggle with reporters, Weiner suggested that the lewd picture may have been "manipulated" and he has retained an internet security firm to investigate. He refused to answer repeated questions about whether photos exist of him in his underwear and whether one may have been "manipulated."

"There are photographs of me in the world. Yes," he said. "We dont know where the photograph came from. We dont know for sure whats on it, we dont know for sure if its been manipulated, if it was taken out of one place and dropped in something else. And i'm going to let this firm try to get to the bottom of all that."

He said he for sure did not SEND the photo.

On why there isn't a U.S. Capitol Police investigation, he said he's retained an Internet security firm that's going to give him advice on next steps. He doesn't believe it's a federal case.

"I believe this is a case of someone sending a nuisance Twitter making fun of my name. We all get spam."

He joked that comedian Jon Stewart may have been right, referring to the fact that Stewart joked it couldn't have been him due to its size.

Weiner tried to deflect questions with jokes. He said, in one attempt at humor, that he regrets being a little bit "stiff" yesterday with reporters.

1) There is a difference between immoral versus illegal activity. The day David Vitter is thrown out of office for soliciting prostitutes is the day I'll care about sexual activity in other politician's private lives. Finally Ensign had his up-and-comings. I hope Tom Coburn gets his next.

2) There are these difference between Republicans and Democrats - a) Democrats resign immediately and accept that their political career is over (e.g., Elliot Spitzer, John Edwards), b) Republicans are hypocrites who masquerade as "family values" politicians who point accusing fingers at others (like Vitter, Ensign, etc. did in regard to Clinton) while committing far worse acts, and c) Republican sex scandals have outstripped Democrats 10 to 1 over the last decade.

As for being framed, James O'Keefe has been sued, but he and Andrew Breibart are both due for some serious criminal charges regardless of the outcome of Anthony Weiner's supposed tweet. These guys are the scum of the Earth.

But let it also be said...Never EVER have nude photographs in the first place. Sorry to impose of your personal freedoms Anthony, but even private citizens should heed this advice.

If a United States Congressman's Twitter account is hacked, that - by definition, is a federal case. The investigative body for Congress is the Capitol Hill police. If, for whatever reason, the CHP are not qualified to handle the case, then the FBI gets involved.

I think that the Congressman got caught and does not want to admit it, that's why he's saying that he's using a private investigator.

Barney Frank and numerous others are still in office. If he had just come out and said, yeah it was me and it was a mistaken send it would be over already.     I'm an independent that voted for Obama, but I think it's a no-brainer that this guy, who was a playboy prior to getting married a couple years ago, sent this chick a photo of his crotch.

    Just a couple of comments to add to all the rest:

    First, although Weiner's activities, if they turn out to actually BE his activities, are not illegal, they are certainly in extremely bad taste, especially given that he's married, and they also reflect VERY poorly on a United States Representative. The only reason that this woman -- and others -- were following him in the first place was because of his position, so you can't wholly divorce his Twitter activities from his status as a Representative. In that case, if the picture was of him and he sent it, you have to question his judgment in leaving himself exposed -- both literally and figuratively -- in such a way. You also have to question his judgment, even if the whole thing is a set-up, in following such a young woman, or several young women, in a way that could even raise a hint of suspicion. Finally, you have to question whatever reason he might have for not having "certitude" that the photo was not of him. Again, if you don't want to be accused of bad judgment, then don't display it. If you don't want nude photos of yourself spread around the internet, then don't allow them to be taken. If you don't want your wife to know what you're up to, then don't be up to it.

    All that being said, however, it's exactly those things that make me highly suspicious. The whole thing was way too easy, and Weiner would have to know that the photo to the young woman could be intercepted. It was a risk too great to take for someone whose judgment has always seemed so much better.

    So, while I don't agree with those who agree that the whole thing is only between him and his wife -- there's at least one other person involved, and his position in Congress, as well -- I think the jury has to be out on this until we have more information.

          The article states, and common sense supports that there was photo manipulation used.             1) There is a difference between immoral versus illegal activity. The day David Vitter is thrown out of office for soliciting prostitutes is the day I'll care about sexual activity in other politician's private lives. Finally Ensign had his up-and-comings. I hope Tom Coburn gets his next.

            2) There are these difference between Republicans and Democrats - a) Democrats resign immediately and accept that their political career is over (e.g., Elliot Spitzer, John Edwards), b) Republicans are hypocrites who masquerade as "family values" politicians who point accusing fingers at others (like Vitter, Ensign, etc. did in regard to Clinton) while committing far worse acts, and c) Republican sex scandals have outstripped Democrats 10 to 1 over the last decade.

                                  Could be somebody took the pic of him in a locker room and it's now being used maliciously against him. He was known for chasing models when he was still single...could be a pic took by a girlfriend from years ago that's made its way out of a long forgotten photo folder from somebody's cell or computer. Maybe he barely remembers such a pic and hence his uncertainty.

                                  All of those statements could be and probably are true. Working in reverse of your post, he or someone else could have taken this picture. Bad taste, yes, perverted not really. Someone could very easily have hacked his account and discovered the photo and, as a prank sent it out.

                                  All this can prove, if allowed to be investigated, is that he showed bad judgement in not deleting the photo when discovered.

                                  As to your comment about Edwards, at least the left isn't putting him up as a potential presidential candidate like the right has with Newt. Edwards is history and Newt is still receiving huge sums of money from his supporters who choose to ignore his reprehensible behavior with his wife that died of cancer.

I don't particularly like Gingrich as a candidate for the GOP but you have blown any credibility here with you asinine comparison of Gingrich to Edwards there bios don't even run on any parallel planes. As far as Wiener is concerned he doesn't want this investigated. So he needs to resign but you liberals will allow him a pass as you do all the Dem's that have trashed the high offices they have held but no if the scoundrel has an R after his name to denote his party he's got to go that's why i say self analyze because your ideology has rotted that portion of your brain that allows any objective thought.

                                    So I guess you're right. Gingrich has a history of serial adultery, whereas Edwards has had an affair with one woman. Edwards has since been exiled from the party and any public positions. He is not fund raising for personal gain nor is he running for the Democratic Party presidential nomination.

                                        WTF!! Is he crazy, taking a picture of himself like a stupid teenager. I doubt he sent the picture, but thats not going to help him one bit. You would think these grown men would learn from their peers, this wont fly. As a liberal, I say he be held accountable for anything disgusting he has done. I feel so bad , because this man actually speaks for me, he fights for me in congress.                                                   Even if it is of him and he did it deliberately - seems a bit unlikely, all things considered - I think the reason that 'not a big deal' is being made of it is because, unlike the recent batch of Republicans, he's not out and about campaigning on his 'family values.'

                                                  No one really cares who is interested with whom or sleeping with whom - or they shouldn't, anyway. Personally, I could care less if any of them are off hiking the Appalachian with Governor Sanford. The issue that causes problems for Republicans, really, is the hypocrisy of campaigning on family values and violating their campaign image at every possible opportunity.

                                                  If he was a Republican, he would be preaching non-stop about family-values. He would have spent his career demonizing and penalizing people who did this, without wanting to pay for the incarceration. This doesn't excuse his behavior, but at least he isn't a hypocrite on top of being a pervert (assuming he is guilty).

                                                      Well said Hypocrsy1776 - At least he is not pushing anti-gay legislation while being drunk in front of a dorm of male paiges and asking who wants to have sex with him (Foley) or soliciting a under cover officer for sex in a airport bathroom (Craig) or park bathroom(Allen) or having meth induced gay sex with male prostitute (Haggard) or having an affair with a staffer while his wife lies dying in a hospital with terminal cancer (Gingrich) or having an affair with your aids wife and then paying off the staffer with mom and dads money while giving the woman a well paid job (Ensign) or having a 12 year affair with the maid then having a illigitimate kid one week after you have a kid with the wife (Sperminator). I just love how the GOP have completely conned the public into thinking they stand for family values. Their motto should be - Do as I say not as I do. Give the Dems credit for not telling Americans what they can and cant do in their bedrooms or with their bodies. Sure its ok to have drug induced Gay sex if your a Republican but if your John Q Public that is a big no no especially if you want to serve your country. This is just more evidence that the GOP represents the wealthy 1% and uses issues like Gay marriage and abortion to get people to vote for them while they have gay sex and force staffers to have abortions to avoid an affair coming into the public light. GOP = HYPOCRASY
