Honor killing is against Islamic laws

By ARAB NEWS

Muslim women have been the unfair victims of many brutal cultural practices. Honor killings are seen as the most gruesome of these. Islam has clear laws regulating sexual conduct and killing a girl in such a manner is against the fundamental principles of Islam.

The practice of honor killings is, obviously, rooted in the erroneous notion that the honor of a family revolves around the sexual conduct of women. This leads many Muslim men to murder their young daughters or sisters in cold blood. This inhuman practice, a modern version of the pre-Islamic practice of burying female babies alive, is present in some Muslim countries.

While some Arab countries, Iran and Afghanistan are involved in honor killings, the largest number of victims is reported to be from Pakistan and Jordan. No statistics about such killings among the Muslim communities in India are available. However, a number of fire incidents where young women have burned to death could be linked to either the honor of the family or insufficient dowries.

A woman can be targeted by her family for a variety of reasons, including infidelity, premarital sex or seeking a divorce from even an abusive husband. The mere perception that a woman has behaved in a way that “dishonors” her family is sufficient to trigger an attack on her life.

A raped woman is killed by her relatives because she is a source of shame to her family and the only “manly” way to regain the family honor is by shedding her blood.

Refusing to enter into an arranged marriage is also an excuse to kill a girl. In 2008 three teenage girls were buried alive by their tribe in a remote village in Pakistan as punishment for damaging the honor of their families after they refused to enter forced marriages. Over the course of six years, more than 4,000 women have died as victims of honor killings in Pakistan from 1999 to 2004. In a recent media report from the subcontinent, a 50-year-old Muslim woman was forced to walk naked on the streets after it was suspected one of her sons had had an affair with a neighbor.

It is ironic that many Muslim communities have developed a sense of honor that is far removed from the fundamental teachings of the Holy Qur’an. The most honorable in the eyes of Allah is the most righteous irrespective of sex or tribe.

“O mankind, indeed We have created you from male and female and made you peoples and tribes that you may know one another. Indeed, the most noble of you in the sight of Allah is the most righteous of you. Indeed, Allah is Knowing and Acquainted.” (Al-Hujurat: 13)

Women have no specific criminal laws in Islam. Sex outside marriage is unlawful and its punishment, which does not distinguish between man and woman, has also been clearly specified.

But those obsessed with their spurious honor have scant respect for the Holy Book. When an unmarried man, a son or a brother, commits a sexual violation, his relatives condone it in violation of religious law and defends him against criticism.

On the other hand, if the offender is an unmarried or married daughter or sister, the relatives kill her. The punishment for a sexual offense committed by an unmarried woman or man, according to Islamic law, is usually only a specific number of lashes. In any case, whether the suspect is married or unmarried, there are specific legal procedures to be followed.

Another major legal issue involved in the honor killing is that the girl’s relatives believe that their honor is compromised just because a girl talked or met with another man. It is not an act that deserves execution according to Islamic teachings (Shariah).

It has also been noted that a potentially erring woman’s relatives are persuaded to kill her after only hearing some rumors. According to Islamic law, no person should be punished without concrete evidence, particularly when slanderous allegations against women are involved. A man or woman is viewed as innocent unless the case is proven beyond doubt by four witnesses as stated in the Holy Qur’an: “Why did not the believers — men and women — when you heard of the affair — put the best construction on it in their own minds and say, ‘This (charge) is an obvious lie?’ Why did they not bring four witnesses to prove it? When they have not brought the witnesses, such men, in the sight of Allah, (stand forth) themselves as liars!” (Al-Noor: 12 and 13).

A believer should not be influenced by the principles of false tribal honor of the days before the Prophet (peace be upon him). On the other hand, Muslims should follow the Holy Qur’an, which says: “Do they then seek the judgement of (the Days of) Ignorance? And who is better in judgment than Allah for a people who have firm Faith.” (Al-Maidah: 50)

The so called honor killings in the name of Islam is, as the previous commentator stated, nothing that should even be written in the same sentence. This due to the contradiction.

Its like saying, To be a monotheistic polytheist or someone is a goodbad person.
And as the article highlights; We Muslims must start do something to stop this practice of honor killings. And the best way would be to educate the Muslims about their religion. Most of the honor killings that occur on muslim land are made by rural population or tribe populations. Whereas many if not most of the rural and tribes people are illiterate and cannot read or understand their religion properly.

So educate muslims about their religion and start an anti honor killing campaign on international lever. Muslim countries should take more responsibility to protect human rights that are in accordance with sharia internationally.

Also worth of mentioning is that many of the honor killers usually are not so religious. For example the kurds that are famous for their rampant honor killings are usually secularists or communists and they actually despises Islam. So this shows that the phenomena of honor killings is more linked to cultural and heretical values than Islamic ones.

If honor killing has nothing to do with Islam, then why does the Sharia Law Manual, Umdat al Salik (Reliance of the Traveller) specifically state that a mother or father who kills their child or grandchild is EXEMPT from punishment?

Book O: Justice, Section 1.2

The following are not subject to retaliation:

1- a child or insane person, under any circumstances (O: whether Muslim or non-Muslim.
The ruling for a person intermitently insane is that he is considered as a sane person when in his right mind, and as if someone continously insane when in an interval of insanity. If someone against whom retaliation is obligatory subsequently becomes insane,
the full penalty is nevertheless exacted. A homicide committed by someone who is drunk is (A: considered the same as that of a sane person,) like his pronouncing divorce (dis: n1.2));

2- a Muslim for killing a non-Muslim;

3- a Jewish or Christian subject of the Islamic state for killing an apostate from Islam (O: because a subject of the state is under its protection, while killing an apostate from Islam is without consequences);

4- A FATHER OR MOTHER (OR THEIR FATHERS OR MOTHERS) FOR KILLING THEIR OFFSPRING, OR OFFSPRING'S OFFSPRING;

5- nor is retaliation permissible to a descendant for (A: his ancestor's) killing someone whose death would otherwise entitle the descendant to retaliate, such as when his father kills his mother.

I am confused. If honor killing has nothing to do with Islam, why does sharia law permit it and state that the parents are not to receive retaliation for it? Indemnity would not apply in this situation either.

Please,my Brothers and Sisters in Islam...
If you would but try to go back to the teachings of the Holy Qu'ran, then things like "honor" killing would be a thing of the past. I invite you to live a life according to the 'Sunna' of the Prophet Muhammad (peace be upon him) and according to the teachings of the Holy Qu'ran. Get away from the "Sect-teachings" made by man!!!

And may Allah have mercy on your Souls

Honour killing has never happened in the East Asian Muslim community. It is prevalent in Middle East, where killing of girls is rampant even before Islam come into picture. And I can tell with 150% surety that honour killing is not even mentioned in the Quran or form part of the Sharia Law. Those who claim to kill in the name of Islam are nothing but a bunch of criminals.

These so-called "honour killings" definitely DO NOT belong to the culture of Islam. Lack of education is the only reason why these barbaric things are practised. The government of these countries must put heavy charges on people practising this. People, especially women, have to be made stronger so that they are not afraid of speaking out. These practises are giving others a very wrong image of Islam - hence, lots of Westerners have one question - "If Muslims say Islam is a religion of peace, then why is all this blood-shed visible?"

I am a Pakistani Muslim, and I can tell you that a lot of tribal (and even educated) people in my country do not know ABC about the basics of Islam. Some don't even know the Kalma/Shahada. Many dont know how to pray. Some completely forget by not practicing. This is the level of their illiteracy. How exactly do you say that they follow and represent Islam?

On the other hand, there are some people who dedicate their entire lives to finding illiterate (partly or wholly) Muslims doing wrong things so they can get a chance to throw dirt on Islam. To those people: in the long run you will fail trying to degrade Islam no matter what the devil promises you.

Great article- thank you for clarifying to the world the difference between Islams teachings and the tribal crimes committed by people. It saddens me though that this article was so hard to find compared to the many false anti-Islamic articles out there that states islam condones or even encourages honor killings.

Honor killings are a problem in the World, but they are NOT Islamic. Saying they are is like saying the domestic violence and rape cases in the US are a Christian problem.

Once again, as with many of the world's religions, there is a discrepancy between the principles and philosophies of the religion itself, and the actions of some of its followers. Not all Muslims abide by Islam, just as not all Christians, Jews, Hindi, Bhuddists etc fully follow their respective religions.
