Police arrested an intruder armed with scissors in the garden of Miley Cyrus's home last night.

They responded to a 911 call after Jason Luis Rivera climbed over a tall fence around the property to gain access.

According to a local news channel the 40-year-old had been sitting in the garden lighting candles and ignoring requests to leave. Miley was not home at the time of the incident.

KTLA recorded the moment armed police apprehended the man, who claimed he was 'a friend'.

With guns drawn the LAPD officers approached the Studio City house, shouting 'step out the gate, step out the gate'.

When Rivera did not at first comply an officer entered the property and threatened to taser him, before the intruder came out with his hands up.

Around the 5ft10 man's neck was what looked like a necktie, but when an office pulled on it a large pink heart came out of his shirt.

'I'm a friend of Miley Cyrus,' the man mumbled, seeming spaced out. 'I am. Me and Miley have been friends for five years.'

As officers questioned him and removed a large pair of scissors from his back pocket the man continued to insist he knew the 19-year-old actress and singer.

According to KTLA Riviera, who can be hear identifying himself on the tape, 'had a lengthy record in Texas, including a trespassing charge'.

A booking sheet showed bail was set at $1,000.

Miley is currently preparing for the launch of her first solo album.

The former Hannah Montana star recently cropped her hair short and bleached it peroxide blonde.
