'Garden-grabber' plan is approved
Thursday 12th August 2010
Land For Sale News Article.

A DEVELOPMENT in Lymm could be one of the last to avoid the Government’s new ‘garden grabbing’ laws.
Developers want to redevelop a plot of land on Eagle Brow in the centre of the Cheshire-set village.
But a meeting of Warrington Borough Council’s planning sub-committeelast Wednesday heard that the building work may not have gone ahead wereit to be submitted now.
The new coalition Government has announced that under the so-called‘garden grabbing’ rule builders will face far more stringent rules whenlooking to develop houses on gardens.
As the application had already been submitted before the new law was brought in, it will not be subject to the new laws.
The Town Hall meeting was told that the scheme would lead to one home on the land being demolished and two new detached homes being built.
Councillors heard the work would see the loss of 13 trees — but it was the fate of one magnolia tree that attracted most attention.
Resident Dr McLean said his wife would ‘chain herself to the branches’ rather than see the tree lost.
He said: “This is a listed building in a conservation area and the new buildings are three times the size of the existing ones.”
Planning officer Richard Evans said there was no guarantee the tree, which has stood since Victorian times, would survive the work needed to complete the development.
But members of the planning committee ruled that while they wereconcerned over the tree and a possible dispute over who owns access to a drive within the site, the development could go ahead.
