Judge: Family’s $80 Million Gold Coin Collection Belongs to Uncle Sam

A judge has ruled that ten rare gold coins worth roughly $80 million belong to the U.S. government, not the family that possessed them, according to ABC News.

In 2003 Joan Langbord and two other family members opened a safety deposit box that belonged to Langbord’s father, Philadelphia coin dealer Israel Switt, and found the valuable collection.  When they asked the Philadelphia Mint to authenticate the find, the coins were apparently seized without compensation and taken to Fort Knox.

The 1933 Saint-Gaudens double eagle is “one of the most sought-after rarities in history,” according to Courthouse News.  Originally valued at $20 each, one owned by King Farouk of Egypt reportedly sold for as much as $7.5 million at a Sotheby’s auction in 2002.

The Langbords unsuccessfully sued the government in 2011, alleging that the coins are rightfully theirs, and now they have lost the appeal.

Jacqueline Romero, assistant U.S. attorney in Philadelphia, explained that the coins legally belonged to the government after Franklin Delano Roosevelt ordered citizens to exchange their gold for cash in an effort to keep the banks afloat during the Great Depression.

“Those coins were all in a vault and were supposed to be melted,” she asserted.

The family maintains that in another seizure of the valuable coin, the government split the proceeds with the original owner after it sold for $7.59 million in 2002, and that the coins escaped the Mint legitimately through a “window of opportunity” between March 15 and April 5, 1933, the Huffington Post relates.

However, U.S. District Judge Legrome Davis Jr. wrote in his decision: “The Mint meticulously tracked the ’33 Double Eagles, and the records show that no such transaction occurred…What’s more, this absence of a paper trail speaks to criminal intent. If whoever took or exchanged the coins thought he was doing no wrong, we would expect to see some sort of documentation reflecting the transaction, especially considering how carefully and methodically the Mint accounted for the ’33 Double Eagles.”

“Nobody witnessed the disappearance of the 10 coins, but the jury could – and did – properly infer criminal intent,” Davis added.

Barry Berke, the family’s attorney, concluded for ABCNews.com: “This is a case that raises many novel legal questions, including the limits on the government’s power to confiscate property.”

    This gold is not stolen gold, or robbed from a bank….The government said “Hey our bank buddies are failing so we need all the people who own gold to sell it to us at a % of what its really worth”

    This should be an eye opener for anyone “Investing” in gold. This is not the first time the government has stolen gold from its people in our nations history and it wont be the last. Don’t invest in gold.

      The federal government keeps pushing and pushing by violating the Constitution, and by making up laws as they go along. If there coins were stolen from the government, fine, but I seriously doubt that’s the case.

      For those who blame Obama for this decision, take a look at who nominated the Judge – “On January 23, 2002, Davis was nominated by President George W. Bush to a seat on the United States District Court for the Eastern District of Pennsylvania vacated by Edmund V. Ludwig. Davis was confirmed by the United States Senate on April 18, 2002, and received commission on April 23, 2002.”

      In September of 2011, Romney participated in the TEA Party debate and was asked about the federal reserve.

      Mitt Romney said, “…But at the same time, we recognize that we need to have a Fed. Why – why do I say that? Because if we don’t have a Fed, who’s going to run the currency? Congress?       It was by Executive order that FDR required all people who owned Gold Coin and Gold Certificates to turn them in and this was the beginning of the end for the other branches of the Government by allowing that order to stand as law instead of challenging it! The Executive order only applies to the Executive Branch and does NOT have the force of law any where else! The Courts are cutting their own throats by allowing this to stand!

      Just so everyone is clear– This was a case about theft of the coins. The coins should have been at the mint. There is no record of a transfer to the family. Yet the family had them. This speaks to criminal intent. The point is that in all likelihood, these coins were stolen from the mint.

      PS–you all REALLY need to go to a source other than The Blaze to get your news. You are getting incredibly watered down and inaccurate news stories.

      Soilddove – You need to use logic instead of just believing the government. You say there is no record of a transfer to the family so it must be theft. And the judge references how great the record keeping was and since there is no transfer record it must be theft. So can either you or the judge explain to me how, with such outstanding record keeping, there apparently is no record of them being missing – at least not one mentioned in the article?

      Now everyone knows why we have black market sales. These people had a dumb lawyer that was probably working for the treasury. Any first year lawyer would have pointed out that they were no reports of a theft in 1933 when all thee gold was taken in and melted. The only way these people gots the coins was for about 2.5 hrs. when the mint opened and then got the call from the president to stop all sales. This man traded $20.00 gold coins for the newer and it was leagal for coins to be sold at the mint.

      Waterspeople: I totally agree with ya on the “Fire” thing! When my father, a WWII vet, passed away, I asked them for several records of his service. Their response: We lost many files during a FIRE!

      I was so pissed off. My dad nearly died on Normandy Beach, and these A$$wipes can’t confirm which battles he served but could tell me that he served his time, went home, and then Re-Enrolled in Service after a couple months back home (which I never knew). If they had that, why didn’t they have the other information?? It seemed ridiculous that information was saved in the “Fire”!

      Give to Caesar what is Caesar’s. Government minted coins do actually belong to the government and this is the reason why they cannot be copied, defaced or destroyed by private persons. This coinage and bills are used for transactions public and private, but the government can dictate by law what coins or cash will be accepted or nullified. If you have old cash from way back in the day, even 20 years old, you would be best served to translate it into silver…not gold. But update it atleast with currency of the time if your going to hold it, its better to keep only a few thousand dollars on hand for emergencies…ie ATMS won’t work, power outages etc. Gold drives too many people crazy esp the Gooberment.

      I have said it before, and will say it again. There is a reason the military has new powers to police the people. I am in the military, and believe that no matter the outcome of the next election, power will be seized by the federal government. None of my friends think it is possible, but they would not believe the feds could confiscate personal wealth.       They gave you (thier livestock) a number so they could track you and garnish your wages.

      In 1944 at the bretton woods agreement the lien on the bankrupt U.S. was transfered to the IMF and World Bank.

      These two financial institutions created the United Nations the following year.

      They have been the trustee of the bankruptcy. This explains their monumental influence over our Sovereignty.

      In 1992 (The same year the UN’s Agenda 21 was introduced) Bush signed executive order #12803

      Of course with the stupidity of the government they, rather than get a whopping amount of money through taxes when these coins are sold, instead just steal the coins. The gold that these coins contain could not be worth more than a few thousand dollars. It’s the rarity of the coin that makes it worth so much. Good job Uncle Sam. Once again, the demonstration of how utterly devoid our government is of any sign of intelligence is made utterly obvious by this example.

      No, invest in gold and silver. Its the only thing that will hold value as they devalue the dollar. Insure it with guns and ammo.

      Consider not buying US coins, maybe Krugerrands or bullion. You could also go so far as to store in a private vault company overseas.

      This is why I do not trust any of the enticements to invest in gold. If it has been confiscated by the government in the past, it most certainly will be again, and will be worthless no matter how much one has amassed. And if you think that will only apply to bullion as in the past, you are not in touch with reality.

      We have a president who is summarily dismantling our Constitution and our rights. There will soon be little left aside from what you can beg, borrow, or steal. True value will be in services and necessities, like food, shelter, and clothing. “Savings” will be what is required to survive from one day to the next. The future will be uncertain. If you think it cannot happen here (and no one ever has thought it could), think again.

      I recently met with a financial planner, the usual questions asked about gold, silver, and real property. He said if the presumed crash occurs, the most valuale trade item will be bullets. Secondly would be food, but bullets would be needed to protect or acquire food. The government recently made an order for nearly 750 million bullets for Dept. Of Homeland Security, the IRS, NOAA, Social Security, and other agencies you would think were not armed.

As Dave Ramsey would say; Why invest on Gold, when in fact the government could take it away, and you would not be able to trade for anything with it. Invest on things that when all goes to you know where, people need. Collect things people will need, that’s how you could survive, by trading (Food, Water, Clothes, Utensils, TP, paper and pencils, etc…) Is not bad to have gold, but it has happened before and will continue (Government take outs). Make sure you have food, water sources, rations saved, and things you can trade, that’s the key, not Gold.

      Also I agree with COLT1860 the constitution gives Congress the power to regulate and manage our money, so why we need the FED?, all they do is create more and more debt, and slowly but surely bankrupt the country.

      All Pro you got that right. And to Captain George the reason the gubment prints the money is because it is backed by the gubment so that all will take it. When you are paid with it it is yours to be exchanged for goods and services up to its value.
      As far as the gun control I sent a letter to my reps in the crappy state of Ca and was told by Feinstein thanks for the letter but since she disagreeed with my position she would do it her way I guess that tells you all who is working for who.

      Lawyer here. Juries often have to infer intent because the accused rarely says “I intended to do x.” Many crimes require the accused to have the intent to do something. For example, first degree murder requires that the accused had to have the intent to kill the deceased. Intent is something that exists in the mind and the only way a jury can usually decide whether the accused had the intent to kill is to infer it from the actions of the accused. So if someone shoots a person 10 times but says he didn’t intend to kill, the jury can probably infer that he did indeed intend to kill based on the number of shots.

      Doesn’t matter who appoints a judge. They all work off precedence instead of principle. If the precedence violates the principle enough times the principle gets overruled. We can thank our elite institutions for training our lawyers rule by precedence and not principle It is the reason the Constitution is an ineffective legal instrument. If people risked the penalty of death for treason for subverting it, It might have retained its power for longer than 150 years.

      As it is, only it will only gain its value once people know that life is lost when it is subverted.

      I believe that George Soros and his co-conspirators (NWO) will force the American economy to collapse before the election if it becomes clear that Obama cannot win re-election. The ensuing riots over food will result in Obama declaring Marshall law and “temporarily’ suspending the election. Our guns will be collected by force by our police and DHS, and then they will do whatever they want with us and our country. If they can fix the election and be assured that Obama will win, they will hold off the economic collapse until after they have confiscated our guns over a little longer period of time. They would prefer Obama to have another term to finish us and America off. They are not as ready as they would like to be to implement such a gun grabbing plan in the next 8 weeks. I do not believe that Romney would go along with such a planned destruction of our Constitution if he were to win.     It’s like this….say I inherit a house from my uncle, in the attic, I find the Mona Lisa, the US Constitution, and Bags of Gold Billy the Kid stole from Wells Fargo. I take all these and try to go sell them, the fact that all these items would have been stolen and never rightfully my uncles makes them stolen property. That’s it, bottom line. No one knows how the coins ended up in their hands, but they know they belonged to the US Treasury and were never legally sold. Thus, stolen goods.

    What happens to a Pawn Broker if he buys a stolen watch, but then finds out it’s stolen? HE is out the money he paid the crook, and the police take the watch.

      Brilliant arguement…………..assuming that the law actually matters these days. It doesn’t whether it’s civil or criminal law. One tax payer dollar should not have been wasted on the salaries and benefits of the judge or the US atty involved. Go after real crimes, like Fast and Furious or the NBP’s committing Federal Hate Crimes by threatening citizens on air and in print. Won’t happen because the law simply doesn’t matter. The rules of the game change daily to the advantage of those with ‘titles’ to the disadvantage of those that don’t have ‘titles’.

      I understand and agree with the fact FDR took gold away from people, unconstitutionally. But, these coins, from what I remember about them, They were produced by the mint, and never were released into circulation. The coins were stolen or sold by someone in the mint, and never actually were authorized to be circulated. So no matter what, these coins were stolen from the treasury, that is why the courts ruled this way. The same went for other coins that were found, records show that they were turned into the treasury, but were taken or sold unlawfully.

      It’s like I said, why these coins are so valuable, is they were never officially released, ever. The Mint produced them, but they were never issued. That is why the only ones owned publically are with foriegn investors, outside the US, they are stolen property. If it was a 1932 or older, no problem, but the 1933 was NEVER released. This is like going into the US Mint, taking a bunch of 2013 coins, say the Mint never releases any coins that year and destroys them, then suddenly, you pop up and say, I have a 2013 coin, and its mine. No, you or someone stole it, because it was never released by the Mint.

      Please stop being critical of Michelle. Couldn’t you guys see the heartfelt sincerity in her eyes as she pleaded for another four years? What a great speech she gave. All she wants is for our food choices to be limited, so that we can be healthier. So what if she takes a lot of vacations. You would too, if you could afford it.

    There should be a solid argument for statute of limitations on the violation of the law. Also, the decendants of the original owner did not commit any crime. Take it to the Supreme Court. That Judge sucks.

      The Statute of LImitations wouldn’t apply. If your great great grandfather robbed a bank, you couldn’t be charged with te crime, but if you found the money in your basement, it still wouldn’t be yours.

      The grandfather didn’t steal it, just didn’t turn it over to the government when FDR decided that people couldn’t legally own gold. People hoarded many things during the Depression, if they could have gotten away with it gold. The old man figured that eventually the government would reverse their position, that’s why it was in a safe deposit box. I would have done the same thing. Theft was not the issue. Possession was.

      I’m not sure any law was broken ,, it wasn’t a law it was a presidential order that has since been rescinded… What’s the statute of limitations on petty theft …$20*10 = $200.00
