Woman who wrongly served 13 years for strangling daughter wins $2.7million after evidence shows teen overdosed on cocaine and the mother's boyfriend was with her when she died

A New York woman who spent more than 13 years in prison after being wrongfully convicted of killing her teenage daughter has reached a $2.7 million settlement with the state.

Lynn Dejac Peters sought $10 million from the state after being convicted in 1994 of strangling her 13-year-old daughter, Crystallynn Girard, in their Buffalo home.

Peters' second-degree murder conviction for allegedly strangling the teen was overturned in 2007 after newly analyzed DNA evidence placed the mother's former boyfriend in Crystallynn's bedroom around the time she died.

Peters' second-degree murder conviction for allegedly strangling the teen was overturned in 2007 after newly analyzed DNA evidence placed the mother's former boyfriend in Crystallynn's bedroom around the time she died.

Authorities later determined that the girl died of a cocaine overdose.

'We have reached what we consider to be a fair settlement for the state’s role in this injustice. We still have suits against the County of Erie and the City of Buffalo for their greater and active participation in Lynn’s wrongful incarceration,' said Peter's lead attorney, Steve Cohen, at a Tuesday news conference, the Buffalo News Reported.

The authorities later maintained that the girl's death was the result of a cocaine overdose, Cohen believed further investigation into may be warranted as there is a vaginal swab taken from her body during the initial investigation that has never been scrutinized.

 

Cohen believed it might provide evidence linking the girl to Dennis Donohue, an acquaintance of Peters who was given immunity in exchange for testifying against her.

Donohue is now serving a 25-to-life sentence for the murder of another woman, Joan Giambra, and is suspected in multiple deaths.

Crystallynn's body was found in the same position as two women who's murders have been tied to Donohue.

Don't count her money until it is in her hands. Winning a lawsuit is not the same as settling and actually getting the money. More often than not the victim never sees a dime.

Thank God she wasn't executed! They just want to pay that to her? The woman lost her daughter, her freedom, her self steem and God knows how much abuse she suffered from her inmates in there. She deserves at least a million per year. I hope the person who killed her daughter is punished and that this woman finds some closure.
