They used his name and his famous six-pack to promote their protein-infused line of Devotion Vodka.

But according to Mike 'The Situation' Sorrentino, the beverage manufacturers are a faithless bunch who have short-changed him on their deal.

The Jersey Shore star has filed a lawsuit for $5million against Devotion Spirits, the makers of the liquor, TMZ reported on Sunday.

Sorrentino, who is sober after seeking treatment for alcohol and prescription drug abuse earlier this year signed an endorsement deal with Devotion in 2010 but claims the company has not held up their end of the business arrangement.

The buff reality TV star states he is due a 2% stake in the company, a $400,000 buy back option for his shares and copies of the company's sales reports.

Mike, 30, says that even though he performed his contractual obligations, Devotion kept looking for an excuse to cut him out and avoid paying him the money he's owed.

TMZ claim the Jersey native is suing Devotion for his entire 10% share in the company, which he estimates to be worth as much as $5 million, and other damages.

Devotion vodka contains a clear protein called Casein which can support an increase in lean body mass and a decrease in body fat if the user is also on some sort of weight training program, according to their website.

Marc Sorrentino, Mike's brother and manager, brokered the deal through the company they run together, MPS Entertainment.

After to shooting to fame in 2009 for his belly baring antics on the reality TV show The Jersey Shore, Mike is estimated to have made more than $5 million in 2010, the second highest of any other reality star after Kim Kardashian.

And the flirty Guido not also has a number of other lucrative endorsement deals with candy store the Sugar Factory, Boca Tanning Club, GNC and Flow Formal Wear, but last year he was reportedly offered a substantial sum of money by fashion retailer Abercrombie & Fitch not to wear the company's clothes.

A spokesman for the company explained : 'Mr Sorrentino's association with our brand could cause significant damage to our image.'

The Situation has also generated income by penning a book called Here's the Situation: A Guide to Creeping on Chicks, Avoiding Grenades, and Getting in Your GTL on the Jersey Shore, which sold an estimated 12,000 copies, releasing a rap song titled The Situation and starring in a workout DVD.

In March of this year The Situation went through an alcohol detox before entering the Cirque Lodge in Utah for substance abuse.

He reportedly revealed that his frequent paid club appearances, estimated to be in the six figure range, had been to blame for his escalated his alcohol abuse.

But a source told Radaronline: 'Mike leads a very expensive life and he doesn't want his lifestyle to suffer because of his decision to go to rehab....he doesn't want it to affect his bottom line.'

This would be a problem for any of his cast members, who are known for their wild, hard-partying ways.

Unfortunately, it's a huge problem for The Situation, who reportedly doesn't want to give up his club-going ways once he's out of rehab.

RadarOnline.com says that part of the reason for his desire to get back in the club is because of the cash he rakes in from his club appearances.

The site reports that he has become quite dependent on the income his presence commands, which is allegedly in the six figure range.

Congratulations on your sobriety Mike. Not easy. It does make his part in promoting Vodka rather strange. Would have thought his contract would end if he clearly didn't use the product. And Mike, please don't ever use the product. Your sobriety is worth more than any amount of money. Good luck.
