Legal move: Brooke Mueller went to court on Friday in an attempt to regain custody of her children
Brooke Mueller has failed to regain custody of twin sons Bob and Max after a court bid on Friday.
According to TMZ, the 35-year-old troubled ex-wife of Charlie Sheen sent lawyers to court on Friday to try to remove her children from the care of Charlie's ex-wife Denise Richards.
The website reported Brooke wanted her children to stay with her brother while she receives rehab treatment at The Betty Ford Centre at Rancho Mirage, near Palm Springs, California.
It is alleged she fears Charlie's 'volcanic temper' will put the twins 'in harm's way,' and that leaving them in Denise's care will 'expose them' to Charlie, as he lives in the same gated complex.
Charlie has two other children by the former Bond girl - Sam, nine, and Lola, six.
Brooke's lawyers went to court with what they claim are sealed documents 'outlining a pattern of violence,' reports TMZ.
Sources told TMZ that Charlie and Denise consider Brooke's alleged plan 'ridiculous' because her brother has 'no real relationship' with the twins, and a move would mean unnecessarily uprooting their lives.
A judge agreed and denied the request late Friday.
A source told RadarOnline: 'There was no second guessing from the judge, Brooke’s request was shot down.
'The twins will be staying with Denise Richards for the foreseeable future.
'Bob and Max won’t be going out to Palm Springs to see her at the Betty Ford Clinic on Mother’s Day, nor will her brother get temporary custody of them.
'Bob and Max are flourishing under the care of Denise, and the judge saw no reason to change that.'
'The boys are thriving in Denise's house, and since Charlie lives in the same gated community, he has been spending more time with them.'
Bob
and Max, four, have been with 42-year-old Richards since they were
removed from Brooke's care last week by officials who allegedly found
them living in shocking conditions.
Brooke checked into the UCLA Medical Center on Sunday for short-term rehab and her lawyers appeared on her behalf in court on Tuesday.
The Los Angeles County
Department of Children and Family Services removed the boys after
finding them in an 'unsafe environment' related to their mother's
suspected drug use.

The hearing came as reports emerged of shocking conditions within the home Mueller shared with her sons.
According
to TMZ, the judge scrutinised a report on the state of the home
before ruling that the boys should stay in Richards' care.
The boys attended the court hearing on Tuesday, before heading back home with Richards.
They won't be returned to Mueller's care until authorities feel they are in a safe environment.
