The 26-year-old reality TV was initially stopped for speeding by police in the Illinois city, where she has been living with her Chicago Bears quarterback husband Jay Cutler, and then taken in to custody after officers discovered she didn't an Illinois driver's licence.

A friend of Kristin told E! News that the star 'was driving in her car and was pulled over.

'They asked for her driver's licence and when they saw she did not have an Illinois license they took her in.

'She was at the station for 30 to 40 minutes and she paid $150 in bail."

However, Kristen maintains she is still a California resident and should not be subjected to the rule.

She tweeted ‘Who knew having a California drivers license in Illinois was a CRIME to be escorted to the police station to post bail?!! What a morning.'

Kristin then added ‘FYI...I still have an apartment in LA so I'm a resident of California.'

Despite her various business ventures in Los Angeles, Kristin has been spending much of her time in Chicago with Jay and their son Camden, who turned one last month.

And to make her morning worse, the pal revealed Camden was in the car when his mother was taken into custody.

‘Her baby was in the car so it wasn't a great situation,’ the source said. ‘She lives in three different states: She has homes in Nashville, Los Angeles and Chicago. What is she meant to do?’

According to the Evanston Police Department it is Illinois state law that a bond must be posted if a driver doesn’t have a valid licence from the state.

Kristin’s representative told E! News that she is ‘handling the situation’.

She was once known for being a troublemaker on reality show The Hills engaging but she has turned her life around in the past few years.

Last month she posted an adorable snap on Instagram of her kissing son Camden as they celebrated his first birthday.

In the sweet photograph, she can be seen tenderly kissing the cherubic youngster's cheek as he stares off into the distance.

Kirstin captioned the shot with the touching words, 'Happy birthday to my little man! He is the light of my life'

Additionally her career seems to be going from strength to strength with the fashion designer recently announcing that she had designed a collection for the NFL's women apparel line.

The star tweeted her excitement about her latest fashion venture saying, 'So excited to design my first ever collection with @junkfoodtees and NFL Women's Apparel during @nyfwstyle360! #junkfoodnfl.'

The new collection will debut during New York fashion week, which started this week.

Just because you are still a resident of California doesn't mean you aren't also a resident of Illinois, suck it up, admit your error and get the licence like any normal person would - marge , London, 06/9/2013 23:00<<<<<<<<<<<<<<<<<< You can't have two US licenses. Each resident is allowed one license. If she gets an Illinois license, then she will be required to turn in her California license. It's a no-win situation for people who spend a good amount of time in more than one state.

That's rotten that they would arrest her in front of her child for such a stupid reason. Go catch some real criminals!!!

I have to agree with Kristin --- this was a ridiculous, needless episode. People in the U.S. travel and live in various States all the time, and it's not a problem of the "uppercrust." It's the way life is led here. Because the U.S. is too large, it is not practical to have one federal gov't. It would be against the U.S. Constitution to have one agency that issues drivers' licenses. And some of these States are virtually like foreign countries unto themselves. If a person commutes to take care of an elderly parent, or lives various places for business reasons, one can't always be going into a DMV to change a license, or vehicle plates. It becomes absurd. Sounds like one of the cops realized they caught a bigger fish, and decided to stick it to her. Absurd. Actually I have no idea who she is - I don't watch these shows, but overall, just sounds absurd and unfair.

Keep in mind this was in Evanston. Evanston is NOT Chicago.

honestly find American law dull !!! yeah you can drive in london but if you're in York for 90 days apply for another licence ?? - xxxxx, International, 6/9/2013 17:15 Well Illinois is a different state than California, and each state has different laws, so it's not that ridiculous. Most if not all states have a similar law on the books regarding residency and licenses. The state one technically lives is very important as it can have big impacts on taxes, especially in the NYC area where the tax/residency/employment laws get tricky with so many people that commute in from NJ, CT, and even PA.

Ha ha ha California driver's licenses are useless. Anyone can get one and anyone can drive here without one and they do.
