REQUEST FOR PROPOSAL ("RFP")

Ethiopian Airlines Enterprise ("Ethiopian") wishes to receive proposal from lawyers willing to work under a retainership agreement for rendition of legal services.

Scope of Work - Act as independent legal counsel and attorney at law for Ethiopian and prepare statements of claim, defense, appeals and other documents of legal character and represent Ethiopian in any proceedings before any court, quasi-judicial bodies, arbitration tribunal, government administration agency or police stations in Ethiopia, whether on first instance or on appeal (including proceedings at the various Cassation Divisions of Supreme Courts in Ethiopia), and execution of judgments involving civil and labor matters; under a retainership agreement to be signed, initially for one year, renewable subject to Ethiopian’s approvalbased on the performance of the lawyers.

Mandatory Requirements

Each applicant lawyer should be licensed (by the Ministry of Justice) to practice in all tiers of court i.e. First Instance, High and Supreme courts. Each applicant lawyer must submit a copy of his/her renewed license valid for the year 2006 Ethiopian Calendar.

Minimum of LLB Degree from a recognized educational institution with the following working experience:

  • Minimum of Eight (8) years experience as a practicing licensed lawyer litigating civil and/or labor cases before Federal Courts; OR
  • Minimum of Three (3) years experience as a full-fledged Judge at Federal Courts on matters of civil and/or labor litigations, plus Five (5) years experience as a practicing licensed lawyer litigating civil and/or labor cases before Federal Courts; OR
  • Minimum of Five (5) years experience as a litigating in-house advocate in public enterprises and private commercial companies appearing in Federal Courts on civil and/or labor matters, plus Five (5) years experience as a practicing licensed lawyer litigating civil and/or labor cases before Federal Courts.

Each applicant Lawyer is required to:

  • Submit a certificate of work experience from his/her former employer or, from the relevant government institution evidencing the continuous working experience under the lawyering license for the required period.
  • Submit a Resume (C.V.) showing in chronological order, his/her educational achievement and work experience.
  • Have excellent knowledge of the Amharic and English languages, in writing, speaking and listening.
  • To be free from any criminal record and should submit documents showing any disciplinary actions taken against him/her by the Ministry of Justice, if any.

Presence in, or established contact with lawyers in, the regional states; experience in aviation law or aviation related litigations; and computer literacy and communication ability through electronic mail and fax would be added advantages.

Submission Options- Lawyers should submit their proposal on either one of the two Options provided below, but not on both Options.

Option I – Two (2) lawyers, each with required competence and experience indicated above, to submit their proposal, as left and right signatories, as a team. These lawyers will be equally responsible, with joint and several liability towards Ethiopian, for the proper rendition of the legal services. These lawyers shall be willing and ready to work jointly as a team, and individually, on both civil and labor cases.

OR

Option II – A single lawyer, with required competence and experience indicated above, to take over either the civil cases or labor cases of Ethiopian. The lawyer shall indicate in his/her proposal the specific field (i.e. civil or labor matters) on which he/she intends to provide legal services to Ethiopian. A single lawyer is not expected to apply for both civil and labor cases.

Financial Proposal - Ethiopian intends to engage on a fixed lump sum retainer fee. Accordingly, Lawyers should indicate in their respective proposals the fixed lump sum retainer fee they expect for the legal services indicated above.

Interested lawyers should send their wax sealed proposal to the following address: Ethiopian Airlines Enterprise, VP Legal Counsel and Corporate Secretariat, P. O. Box 1755, Addis Ababa, Ethiopia OR submit it in person at Ethiopian’s headquarters, Office of VP Legal Counsel & Corporate Secretariat.

Proposals shall be submitted at anytime from the date of this RFP but before 5:00PM on September 16, 2013 local time.

Ethiopian reserves the right to cancel this RFP in whole or in part, or to accept or reject any proposal, without notice.
