Tom Cruise 'questioned over rumoured love interest Cameron Diaz' in deposition... as he denies attending her 40th birthday party while he was away from Suri

Tom Cruise has been questioned over time spent with his once-rumored romantic interest Cameron Diaz, Radar has reported.

In the transcript of the deposition in his lawsuit against the publisher Life & Style and In Touch, Radar reveal that Cruise spent time with Diaz in August 2012 whilst he was apart from his daughter Suri.

Cruise is suing Bauer publishing for claiming he 'abandoned' his daughter Suri following his divorce from Katie Holmes, in a $50 million libel lawsuit.

In the deposition between Cruise and attorney Elizabeth McNamara, who is representing Bauer publishing, the actor is asked if he attended Diaz's 40th birthday in London in 2012.

'I don’t recall going to a birthday party,' Cruise is quoted as saying, as McNamara suggests that he was with Knight and Day co-star that night.

Cruise then insists: 'I didn’t go to Cameron Diaz’s birthday party.'

He adds: 'You’ve been reading the press. You can’t believe everything you read.'

But McNamara highlights that Cruise was photographed with Diaz at Coworth Park hotel outside London on Diaz's birthday, August 30th.

Despite Cruise insisting that he did not attend Diaz's birthday party, McNamara claims that his lawyers at the time had confirmed that he had.

Speaking on the Graham Norton chat show in the UK near the time, Diaz explained what had happened on the night of her birthday.

'I happened to bump into Penelope Cruz, Javier, Tom and his son in a hotel and joined them for dinner,' Cameron said.

'At midnight I said, "I’m 40" so we took pictures and then said "Goodnight, see you later, blah, blah, blah" and I haven’t seen him since.'

Deposition: Radar report that an 'angry' Cruise began to explain 'when there is a divorce... things change' at the interrogation held at the LA offices of Cruise's lawyer.

'But the next thing I know, apparently I am dating him and it’s full on and he is coming after me.'

Life & Style at the time had reported that the pair went on a 'sexy date' although Cruise's representatives later denied this saying: 'he and Cameron are friends only.'

The case - which is expected to go to trial next year - will see Cruise sue the publisher of In Touch and Life & Style for libel and defamation.

I can't believe I am writing this, as I REALLY dislike Cruise and won't watch his movies . . BUT . . I must be missing something because I can't fathom this issue out at all. Why would it make any difference if Suri was on a visit to him and he went to Diaz's party? If any of us were going to a party, at night, with other adults, our children would be in bed and a babysitter would be in charge. Again, I hate to defend him, but is he not entitled to go out to a party and have a babysitter? It is well known that his sister cared for Connor and Isabella. Please, someone, help me out here.

Call me naive but I genuinely believe he cares about Suri and that he probably never saw the divorce coming, which if he had been paying attention, he might noticed something, I mean, their lives and values and realities, not to mention the age difference, were polar opposites. I can't categorically dump all the blame on him, nor on Katie either...to me it was more a case of a relationship's death foretold. As for Cameron, nah, there's nothing there I think, they're not each other's types either, but having worked together, they're probably good friends and there for each otheR. Nothing wrong with him attending Cam's birthday party...
