'Where is the defendant?' Manhattan Criminal Court Judge Diana Boyar asked Bynes' attorney, Gerald Shargel. 'Is she still in the hospital?'

Shargel answered that she had been released from rehab and discharged into the custody of her parents, but could not be present for the hearing.

He did not give a reason why, and prosecutors were aware that she would be absent, reports the newspaper.

'Judge, we are not asking for a bench warrant,' Assistant District Attorney Laura Richenderfer said.

But the judge insisted that a warrant would be ordered if Bynes did not show up in court at the next scheduled hearing on January 10.

The case is in connection with an incident in May when Bynes allegedly threw a marijuana bong out of the window of her 36th floor apartment.

She was charged with reckless endangerment and attempted tampering with physical evidence.

Good to see she is finally getting her life back on track, but its a shame she couldn't make it to her hearing. Getting her legal woes sorted is really important so that she can start fresh and move forward with her life. She looks a lot more normal here with her parents, with her natural hair and normal clothes on. It would be best for her to retire from the spotlight for good, or at least for a few years.

I wish the paps would leave her alone...she needs time to heal. She seems to have a better relationship with her parents now and that's really fantastic. I really wish her all the best.
