Former Cumberland Valley teacher Emily Nesbit, charged Friday with engaging in a sex act with a student "made a series of bad decisions at a low point in her life," said her attorney in a statement released Friday.

Harrisburg attorney Brian W. Perry says he is representing Nesbit, who was charged Friday with institutional sexual assault. Nesbit, 31, of South Middleton Township, resigned from her job with the district Thursday. 

Friday morning she was arraigned and  released on $100,000 unsecured bail.

Here is the full statement issued by Perry, an attorney with the firm of Grove, Perry and Shore:

"I represent Emily Nesbit in her pending Cumberland County criminal case. This morning, Emily voluntarily surrendered to MDJ (Magisterial District Judge Elizabeth) Beckley and waived her right to a preliminary hearing.

Emily Nesbit (left), 31, is charged with institutional sexual assault for engaging with her 18-year old student at Cumberland Valley High School (right) in Pennsylvania. While the victim is at the age of consent officials in Pennsylvania said his age was irrelevant where teachers are accused of sexual misconduct with their students. ARAPAHOE COUNTY, Colo. — A mom is accused of using her own 6-year-old son to scam people out of their compassion and thousands of dollars in cash. She was arrested Thursday.
The Arapahoe County Sheriff’s office says Sandy Nguyen, 28, told people her little boy ad cancer.
Investigators say she made up the story to dupe people out of more than $25,000 in charitable donations.
“Sandy Nguyen did convince her son, family and community that her 6-year-old son had cancer and was receiving cancer treatment since approximately September, 2012,” a news release says.
An account had been set up for the donations. The community began fundraising efforts at schools and other methods in September 2013. The boy attends Rolling Hills Elementary in the Cherry Creek School District.
“Over the last several months, Ms. Nguyen accepted at least $16,000.00 from that account, as well as a trip to Disneyland for herself and family, which was paid for by the donated funds.”

Police say she convinced the boy and even the rest of their family he had recurring bouts with leukemia and by June 2013 that he had just months to live. Authorities have recovered around $23,000 cash, much of which was raised when a 5K charity was held in her son's name and tickets quickly sold out.
