Land Use for Tobacco Retailers

Land Use for Tobacco Retailers

A model ordinance to utilize zoning codes

This model ordinance is intended to amend a jurisdiction’s existing zoning code for the purpose of regulating tobacco retailers. A city or county that adopts some or all of its provisions must consider where they would best fit into its existing code, and must cross-reference appropriate existing provisions.

These provisions may stipulate the means of enforcing zoning ordinances, as well as provisions concerning notification, fines and penalties; issuance, denial, suspension, and revocation of a conditional use permit; appeals of conditional use permit denials and other administrative and quasi-judicial decisions; and so forth.
