A state appellate court in New Jersey has ruled that a mother's rights were not violated by a judge's decision that barred her from ranting about her children and ex-husband on Facebook.

The judge's 2011 order was a special condition of the woman's probation stemming from an attempt to kidnap her two children and take them to Canada.

The restriction came after the woman's ex-husband's family and Hunterdon County prosecutors argued that her Facebook postings were frightening, saying they referenced the Book of Revelation, serial killer Jeffrey Dahmer, Satan and Adolf Hitler.

'You can talk about what you want to talk about, but don't reference (your husband) or the children,' the judge told her, Mycentraljersey.com reports. 'That's off limits.'

But in 2012, the mother returned to Facebook and began using a code word, 'Camelot,' to refer to her family. The judge found that the posting violated her probation.

 

She appealed, claiming the order violated her rights of free speech and due process because it was too vague.

The appellate panel disagreed, finding the order was specific and didn't prevent her from making posts about other issues. The court said the special condition was imposed with the purpose of advancing her rehabilitation.

The woman, who has been diagnosed with bipolar disorder, was arrested in May 2011 after she tried to take her children to Canada in violation of a custody order.

She eventually pleaded guilty to interference with custody, and prosecutors dropped the kidnapping charge.

The woman wasn't identified in court documents in order to protect the identities of her family members.

Maybe closing off this avenue of ranting would make her worse? If she is crazy, nobody in real life is listening to her, and if she is human, sick or not, she needs at least the illusion of being heard. Dunno. Just wondering.

People need to realize that Facebook is not the end-all answer .. or the place to air all their dirty laundry. Way too many are so sucked into FB that is all they care about....... get a real life!!

I still remember that Jeffrey Dahmer and it's picture is giving me the creeps . Dahmer was beyond sick and twisted. I would be very alarmed if someone kept referencing that evil creature .

Wow, this woman needs some serious help, she sounds like she is a danger to her children and her ex husband, good that the kidnapping was thwarted. I know nothing about bi-polar disorder, but I do know a lot of people use it as an excuse for bad behavior.

This is horrible. Keep taking away people's rights. So what if her posts are offensive? Just block her and unfriend her. No need to have the government step in and BAN her from using Facebook. It seems as if people want the government to be their family member, dear lord...

While what you say makes sense, her rants are both damaging to her children and led her to a real life kidnapping attempt. I'm usually on the side of free speech.
