Angela Stoldt is charged with second-degree murder in the slaying last year of James Sheaffer, a 36-year-old limousine driver who lived across the street from her on Horseshoe Terrace in Deltona.

Stoldt, 42, is also charged with abuse of a dead human body and tampering with physical evidence. After killing Sheaffer, she enveloped his head in plastic wrap, the motion states. Investigators have only found portions of Sheaffer?s body.

?As Mr. Sheaffer was attacking her, Ms. Stoldt stabbed him in the right eye with the ice pick. Sheaffer kept coming at Ms. Stoldt ...? the motion states.

Circuit Judge Randell H. Rowe III has yet to rule on the motion which argues that Stoldt was in fear for her life as an enraged Sheaffer came at her in her car.
