'Frustrated' Melissa Rivers 'will sue' clinic where mother Joan went into cardiac arrest in order to 'find out what really happened'

Melissa Rivers will sue the clinic where her mother Joan stopped breathing, according to a new report.

The late comic died on September 4 in New York City, a week after she went into cardiac and respiratory arrest in the middle of a routine throat surgery.

TMZ claims Joan’s daughter feels that suing Yorkville Endoscopy LLC is the only way forward, after being told by lawyers that without a lawsuit, she won’t be able to find out what led to her mother’s death.

The website reports ‘frustrated’ Melissa wants doctors and other staff at the clinic to take part in depositions and explain what happened to Joan under oath.

A close family friend told MailOnline earlier this month that she planned to sue following her mother’s death aged 81.

And the alleged decision comes shortly after the Upper East Side facility was deemed deficient in four major categories required for accreditation following an investigation by the New York State Health Department.

If it does not correct these problems, it will lose its license on January 7 of next year.

In an October 9 letter to the clinic's director of operations, Tricia Dougherty, obtained by MailOnline, the categories the clinic is 'noncompliant in the following four areas: 'governing body and management, surgical services, medical staff and patient rights.'

It comes following claims by TMZ that Joan’s death would remain a mystery for Melissa as she told doctors not to perform an autopsy.

If there is no evidence of criminality associated with the death, a family member can request no autopsy be conducted, according to New York law.

Last week, the Chief Medical Examiner released results of the investigation into Joan’s death and said that she died from brain damage as a result of lack of oxygen, which is a ‘predictable complication of medical therapy’ – meaning the death was due to a risk associated with the surgery performed on the star.

After the cause of death was revealed, Melissa said in a statement: 'We continue to be saddened by our tragic loss and grateful for the enormous outpouring of love and support from around the world.'
