The deconstruction goes into detail about each and every document submitted to the courts on both Adam Lombardi (Queens Politics blogger) and Jody Kriss‘ (East River Partners frontman and former embattled Bayrock Group CFO) accounts. No stone is left unturned, and the article goes into further detail about Jody Kriss‘ history with the New York Courts System.

The reader is left to decide, is this man doing nothing more than trying to silence his violent and mobster-like extortion campaign? We’ve already seen what Jody Kriss is more than willing to do in order to try and squeeze money out of those who oppose him. Just look at the Jody Kriss v Bayrock Group cases.

This deconstruction should put into light what kind of person Jody Kriss is. The fact that it is repetitive and ongoing shows that he is not willing to back down or let it go. Jody Kriss goes on to attempt to bully Lombardi’s article sources from him, claiming that he isn’t a real journalist.

Serial litigator Jody Kriss yet again finds himself on the wrong side of a lawsuit as of Friday afternoon. As the case of Lewis Pine v. East River Partners settles for $1.6 million against Jody Kriss, a new plaintiff has arose in Joseph Brun. This new lawsuit, titled Joseph Brun v. ERP Park Slope and Jody Kriss, shows again that East River Partners is doing whatever it takes to drive a profit. At this point, are we even surprised at what Jody Kriss will do to line his pockets?

This suit claims that immediately after purchasing the Park Slope building, Jody Kriss filed plans with the city, stating that the building was vacant (which it was not). This allowed them to start a renovation/demolition project with tenants still inside. Exposed to the construction, tenants in the building were met with excessive dust, and harmful respiratory irritants such as lead and asbestos. A nice cocktail that really lets you know the building owner cares about their tenants.

Much like Lewis Pine v ERP, a stop work order was issued by the city of New York, but Jody Kriss and company continued to illegally perform renovation work. Mr. Brun had lived in the building his entire life, and was faced with an outside force attempting to drive him from his home with zero disregard. As stated in the summons: “Their actions “can only be described as ‘mob-like’ or ‘mafioso-like’, bullying tactics intended and calculated to force Plaintiff to do what [they] desired.”

As stated, this isn’t the first time this shady real estate development company has been in hot water over the same issues. In July, they faced a similar lawsuit in which the same acts were performed with zero disregard for multiple families. It continued, even with a stop work order, until two of the families, including one with a three-month old child, had enough and took Jody Kriss and East River Partners to court. They settled with the families quickly, tossing them each $800,000 to a total tune of $1,600,000 plus a settlement clause that forced them to not speak to others about the entire lawsuit.

But what else is to be expected of wannabe gangster Jody Kriss? Kriss himself has been referred to on many an occasion of being a serial litigator, and with good reason. He has been the plaintiff of at least five lawsuits in the past few years, with a total damages payment request of over $2 billion. Currently pending is his personal $1Billion lawsuit against numerous parties, including Donald Trump, the Sapir Family, real estate lenders CIM Group and IStar Financial, numerous law firms, such as Nixon Peabody LLP, Satterlee Stephens Burke & Burke LLP, Duval & Stachenfeld LLP, Roberts & Holland LLP, and Akerman Senterfitt LLP, and an Assistant U.S. Attorney, Todd Kaminsky.

I have been doing research in the real estate development field for a long time, and Jody Kriss is by far the scummiest individual I have come across. Whether it be getting his father fired(From another lawsuit, Kriss v Bayrock II), risking the health of infants, getting his lawyers referred for criminal contempt, stealing confidential information for extortionist intentions, or risking the safety of former colleagues, even stooping to using dead Holocaust survivors as part of an extortion scheme, this mobster will not stop until he bleeds the real estate community and anyone that gets in his way dry.

Next up, the Guinness World Record for wasting taxpayer money.

On July 2nd, 2013, Lewis and Kathryn Pine and Ariel and Shiri Kornblit, tenants of an East River Partners building (274 West 86th Street), filed a lawsuit against Jody Kriss and his company, East River Partners, on behalf of themselves and their infant son, Levi. According to the summons, East River Partners was under a duty to keep the building free of dangerous conditions threatening the life and safety of the tenants.

During April 2013, Jody Kriss and company began an interior renovation and demolition or part of the building, including demolishing walls that were painted with lead paint. Some of the renovated apartments included the apartments surrounding the plaintiffs. The inhabited apartments became dangerous and uninhabitable. Excessive dust was released into the plantiffs’ apartments and into common areas of the building.

Tests by an environmental engineer showed highly elevated levels of lead, asbestos, gypsum, and fibrous glass. No dust controls were put in place, and the environment became dangerous to the infant of the Kornblit’s. The New York Department of Environmental Protection conducted an inspection and issued a stop work order. But the work continued. Even expanded.

Jody Kriss and company were repeatedly told by the Pines and the Kornblits of the conditions and repeatedly refused to stop the renovation and demolition. According to the summons: “Defendant’s actions and/or failures to act, were, and continue to be, deliberate, venal, and calculated to harass plaintiffs, with the sole goal of driving them from their homes in the Building.”

The plantiffs requested $1 million in damages, and $5 million in punitive damages, with all necessary documentation to prove that Jody Kriss and company were deliberate in their scheming, and acted to purposefully harm the plaintiffs in order to ensure that their cashflow was not disrupted and their renovation went without a hitch, building occupied or not.

On August 23rd, 2013, Jody Kriss and East River Partners submitted a response, denying everything except that there was a stop work order placed, that renovations were occurring, and that letters were sent by the plaintiffs to the company, but refuses to disclose what they said. They played the “nice try, but you’re not getting our cash” card, and moved for an immediate dismissal.

On March 24th, 2014, after months of fighting for their rights and their health, the plaintiffs pushed for a settlement of $800,000 for each of the two families to avoid future legal burdens and emotional distress of the families. In the demands per Jody Kriss and East River Partners, it was stated that: “The parties wish to keep the terms of this settlement in the strictest confidence and agree not to disclose same or discuss the contents of same or duplicate the same for use by and other person or entity.”

What does this mean? East River Partners and Jody Kriss fought this lawsuit tooth and nail, all the while continuing their renovation and harmful exposure. Eventually, when the renovation was complete, they moved for a cheap settlement as fast and quiet as possible in order to minimize their losses and keep their pockets full.

In a lawsuit that took almost a year, drawing out the dates in order to finish their demolition and renovation unheeded, they settled within two weeks for $1.6 million with the promise that this lawsuit remains in the down low. Unfortunately for Jody Kriss and East River Partners, all of this information is fully available online. It was a win-win, albeit a dirty and immoral win-win, for the company, at the expense of the health and safety of the families and infant child.

How many more times will this exact scenario take place? How many more health concerns will be dismissed and stop orders ignored? East River Partners currently has seven more buildings. It is only a matter of time before they start renovating the next one. Will your family be the next ones exposed to lead paint and asbestos, with a small lump sum and a “shut up about this” message?

Recently there has been a good bit of news surrounding serial litigator Jody Kriss, a New York City real estate developer who used to be Wharton’s golden boy until he got caught up in the Mob mentality. Jody Kriss currently makes his living buying, renovating, and renting out brownstones and condos all over Brooklyn and Manhattan as a principal at East River Partners. But before starting East River Partners, Jody Kriss held the title of the world’s most oblivious chief financial officer.

Jody Kriss started his life as a low-level junior analyst with the Athena Group, assisting in the financing and development of one 838 Fifth Avenue, which currently sits as the headquarters for the Union for Reform Judaism. After a few years, he left Athena and joined APC Realty Advisors, where he was involved in several other projects for the company.

At some point, there was a magical jump in rank, and Jody Kriss quickly became a managing partner at Bayrock Group, and then made another massive jump, quickly sliding into the position of chief financial officer for the company. The idea was that there were a few shady characters in high positions with Bayrock Group, so Jody Kriss, who at the time was a relatively unknown Wharton graduate with a great reputation and a clean record, could act as a figurehead for Bayrock, and assist in ensuring that they had a sparkling image.

His father was brought in from Akerman Senterfitt, a prestigious New York City law firm, to handle the legal operations of the company. The father-son team now had ultimate control over both the financial end of Bayrock Group, as well as the legal end of operations. Jody Kriss and his father were all encompassing, and nothing should have slipped past their watchful eyes.

Suddenly, lawsuits start flying, and Jody Kriss is ousted from the company, along with his father. It started in Delaware Chancery Court, where Jody Kriss filed a lawsuit claiming that Bayrock Group had been embezzling millions of dollars, defrauding the IRS, and extorting money through threats. Dark questions arose surrounding Bayrock Group’s recent collaboration, the Trump SoHo, as well as other projects the company worked for. Jody Kriss, on the other hand, deleted all of his and his father’s emails from the company servers, stole a company hard drive containing attorney-client communications and federally-sealed documents, and disappeared into the world of the legal system.

How is it that the CFO of a company such as this would be completely innocent if the embezzlement of millions of dollars was occurring? With Jody Kriss as CFO, all financial decisions should flow through him, provided he was performing his job duties correctly. All legal decisions should have flowed through his father. What was the reason for deleting all his email correspondences and stealing a company hard drive before resorting to the Delaware, and eventually the New York, legal system?

Jody Kriss is, and has been for several years now through various frivolous lawsuits, claiming that he had no play in any schemes, yet still feels it necessary to make any evidence that he was even a part of Bayrock Group disappear. He accuses almost all of his co-workers at Bayrock Group of being heavily tied in with the Russian Mafia, and working a massive racketeering scheme through the company, yet Jody Kriss himself, a diligent employee and CFO, carried the responsibility of overseeing where every penny went within the organization.

Jody Kriss spent years at this position, and in this time fails to see any patterns, and is now all of a sudden cutting ties with Bayrock and suing them for upwards of a billion dollars, claiming innocence and ignorance?

Since being ousted from his CFO position, Jody Kriss has been tangled in several high-dollar lawsuits. In addition to two similar lawsuits against Bayrock himself, he also came after a former co-worker hiding behind the false plaintiff of a family of dead Holocaust survivors, using them as a pawn in his serial litigation scheme to squeeze as much cash as possible out of his former job. When he filed a high-profile billion dollar lawsuit against Bayrock and hundreds of others who were involved in the wheelings and dealings of the Trump SoHo, word started spreading fast about Jody Kriss.

A New York blogger by the name of Adam Lombardi wrote an article suggesting ties between Jody Kriss and the Russian Mob, seeing exactly what the rest of the world was seeing. Jody Kriss promptly sued him for $20 million as well. All the while attempting to start up his own real estate development empire, cutting corners left and right, using scummy tactics to get a quick payout, even endangering families and children with hazardous airborne irritants such as lead paint.

Oblivious? I think not. The past few years has done nothing more than prove that Jody Kriss is no more than a low-level scumbag, looking to use the New York legal system to fund his personal gain, and attempting to appear as an innocent party amidst Mob connections and flying lawsuits.

On March 13th, 2014, a blogger by the name of Adam Lombardi wrote and posted an article to his site Queens Politics entitled “Brooklyn Watch Out: Shady Developer With Mob Ties Targets Eric Adams”. In the article, Lombardi explains that Jody Kriss is nothing more than a serial plaintiff out for his own self-preservation, and outlines his legal past with the commission money, as well as the large lawsuits with his name on them.

The article also poses the question: “How can local community boards and BP Eric Adams deal with an investment group that has really no track record only that of a partner who was a front for the Russian mob and acted as a beard for known criminals?”. The article suggests that Brooklyn Borough President Eric Adams could be in danger in the future as a result of Jody Kriss‘ actions.

The next day, a summons was submitted to The Supreme Court of the State of New York, County of Queens entitled Jody Kriss v Adam Lombardi and John Does 1-20, in which Jody Kriss claims libel against the article and demands the sum of $20 million from Lombardi for special damages, attorney’s fees, money damages, and injunctive relief.

A press release was distributed on April 9th entitled “Blogger Responds To Jody Kriss Notice To Sue”, in which the response by Adam Lombardi’s lawyer is explained, claiming first amendment rights. The response also states: “This lawsuit is yet another in a long line of frivolous and meritless litigation commenced by Jody Kriss in the state and federal courts in which he seeks to browbeat defendants into silence and submission”. The case remains pending.

After March 18th 2013, Jody Kriss‘ first civil action had been dismissed and Jody Kriss v Bayrock Group was sitting in eternal New York Courts limbo. As a result of this happening, Jody Kriss filed a third civil suit, this time in the Southern District of New York.

In this suit, entitled Estate of Ernest Gottdiener v Salvatore Lauria, Jody Kriss alleged a civil RICO claim against two former Bayrock employees, amongst them Salvatore Lauria. As Jody Kriss was incapable of being the plaintiff in every legal action filed against Bayrock, he found a nominee plantiff in the Gottdieners, dead Holocaust survivors, and brought the frivolous RICO claim down on Salvatore Lauria and Bayrock on behalf of their estates.

The lawsuit was used as a scheme to attempt to extort money from the defendants using the same attorney-client communications and judicially-sealed documents present in Jody Kriss v Bayrock Group, far past the four-year statute of limitations for a civil RICO claim. The Gottdieners had no connections with the Bayrock Group, and were simply used in another attempt for Jody Kriss to receive $1.5 million in commissions through humiliation, extortion, and blackmail of the defendants.

Again, this information, if disclosed, could put former Bayrock employees and their families in grave danger. Did this stop Jody Kriss from pressing on in the face of the obvious? Of course not…

On May 10th, 2013, the Supreme Court of the State of New York filed a court summons brought forth by New York City lawyers Frederick Oberlander and Richard Lerner, on behalf of plaintiffs Jody Kriss and Michael Ejekam. Jody Kriss is the current principal of East River Partners, and Michael Ejekam is the real estate director of the Africa division of Actis. Both Jody Kriss and Michael Ejekam are former employees of Bayrock Group.

The notice stated that “the plantiffs seeked relief against those directly and vicariously responsible for the perpetration of perhaps a billion dollars or more of fraud” … “as well as other related and unrelated relief, and declaratory relief against those persons, primary financial institution, insofar as to affix by liquidating judgment thereof such liability is owed to them.”

What did this legal jargon all equate to? They wanted money. Lots of money. A billion dollars worth of money, to be exact.

Want some more legal jargon? “Plaintiffs, demanding $1 billion in damages, and all other relief as is just and proper in law or equity, will allege the following and related state law causes of action in the complaint, whether concomitant liability to be found directly, vicariously, or by reason of aid and abettance.”

What did that all mean? The exact same thing. Hammering home the fact that they want $1 billion in damages and restitution.

But from whom? Amongst the long list of defendants were Jody Kriss former employer Bayrock Group, as well as many people associated with Bayrock itself. Also included was his father’s law firm Akerman Senterfitt LLP. His own father, by the way, was forced from his position after the summons came about. Jody Kriss caused his own father to lose his job.

Other defendants in Jody Kriss v Bayrock Group include Tamir and Alex Sapir, Salvatore Lauria, law firm Beys Stein and Mobargha LLP, and even so far as reaching to Donald Trump and Ivanka Trump, amongst many others associated with Bayrock Group, the Trump SoHo, and several other shady dealings Jody Kriss has been associated with.

This summons, by the way, was a carbon copy of an already dismissed lawsuit of the same nature, with fewer defendants, demanding $100 million. This was dismissed, as it was ridiculous in nature. So what better way to let the state of New York know that Jody Kriss is going to stop using them as pawns in your cash scheme than to expand the defendant list and multiply the demand by ten?

This case, much like the original Jody Kriss v Bayrock Group, fell apart quickly after the discontinuation of Donald Trump, Ivanka Trump, The Trump Organization, and the CIM Group on May 31st, 2013, and Todd Kaminsky on June 5th, 2013. On June 14th, 2013, Kaminsly submitted a proposed order to be dismissed as a defendant, and remanding the case. The same day, a removal request was submitted to the Courts.

Jody Kriss and his lawyers submitted an appeal a few days later, on June 17th, 2013, requesting that the case remained, as the dismissal of Kaminsly has rendered the removal request improper. The back-and-froth continued, with things getting worse for Jody Kriss, until the Judge Brian Cohen referred to a possible criminal contempt investigation into Frederick Oberlander and Richard Lerner, Jody Kriss’ attorneys for the case.

Before the case disappeared, many news agencies and bloggers received word of the story of Jody Kriss’ serial litigation tactics, relating documents, and summons, all of which were available and still remain available on the New York City Court website.

This summons, as explained by Salvatore Lauria and many others involved in this case as well as the first, was yet another attempt by Jody Kriss to receive an undeserved $1.5 million payout in commissions through humiliation, intimidation, extortion, and blackmail.
