Sam Worthington and Lara Bingle to face court over clash with photographer in New York... just days after welcoming their first child together 

Just days after welcoming their first child, Lara Bingle and Sam Worthington will be grilled about last year's street stoush with a New York photographer in court.

A US judge has ordered the Australian celebrity couple be deposed no later than April 10 by the lawyers of photographer Sheng Li, who has filed a $US10 million lawsuit.

Bingle, the model and fashion designer, and Hollywood action man Worthington, star of blockbuster film Avatar, welcomed a son at Los Angeles' Cedars-Sinai Hospital last week.

'Defendants shall be deposed not later than April 10, 2015,' US District Judge Lorna Schofield wrote in her order.

Not only will Lara and Sam have to face a paparazzo's lawyer, but the new parents have to pay for his LA airfare, hotel and travel time.

Li alleges he was 'viciously assaulted and battered' by Worthington and Bingle "without any just cause or provocation" on a Manhattan street on February 23, 2014.

The photographer claims he suffered a shoulder tendon tear and injuries to his right thumb, wrist, facial contusions, abrasion, lacerations, mental anguish and post-traumatic stress.

With Bingle's pregnancy in Los Angeles grounding her, Judge Schofield ruled the couple should pay for Li's lawyer to travel to California.

The couple will pay for one economy return airfare, one night in an LA hotel not exceeding $US450 and the actual air and ground travel time for one lawyer at $US300 per hour.

It takes about six hours to fly between New York and Los Angeles.

Judge Schofield also ordered Worthington and Bingle pay for all of the costs if the depositions were instead conducted by video conference.
