Hilary Duff's estranged husband Mike Comrie 'demanding joint custody' of their three-year-old son Luca in divorce battle

Mike Comrie is demanding joint custody of son Luca, 3, with his estranged wife Hilary Duff, TMZ reports.

Comrie has responded to her divorce filing where Hilary had asked for primary physical custody of their son, giving Comrie just visitation.

TMZ claim that sources close to Duff are concerned for Comrie's 'partying antics' and is worried about his parenting skills.

Duff, 27, and retired hockey player amicably separated in January 2014 but then Duff filed for divorce in February 2015.

It was later claimed that Duff filed for divorce after Comrie allegedly asked a woman for sex during a night out in January.

Just this month, Duff claimed that she and Comrie will always be a 'unit'.

She told People Magazine: 'We are a unit and we're going to be a unit for the rest of our lives.'

'We realised [as a couple] we weren't where we used to be. But I feel so lucky this happened when Luca was young because this is his normal now.'

She said: 'It's a shift to have your routine shaken up (but) you can't mess up one day with a 3-year-old.'

'When you make big decisions in your life, you feel powerful. I feel happy, I feel good, and I'm excited about all I have going on.'

And Hilary hasn't ruled out having another child in the future.

She told People magazine: 'The joy that Luca has brought to my life, and the purpose and meaning - there are no words for it. I definitely want that again.'
