Kim Kardashian and Kanye West are allowed by a California appeals court to proceed with lawsuit over video leak of the rapper's proposal 

Kim Kardashian is famous for sharing all aspects of her life with fans, whether it be on her Instagram account or reality show Keeping Up with the Kardashians.

However, in those situations the 34-year-old shared on her own terms - which was not the case when Chad Hurley posted video of now-husband Kanye West's proposal in 2013.

The pair sued Hurley for sharing the video clips, which he appealed, arguing a loophole meant he hadn't violated the confidentiality agreement. But a California appeals court ruled on Wednesday in favor of Kim and Kanye, 37, allowing the couple to proceed with the lawsuit over leaked marriage proposal footage.

The couple - who have 22-month-old daughter North together - went on to state in their suit: 'Hurley proceeded to try to turn the event into one starring himself, broadcasting the images he knew were the exclusive property rights of someone else.'

The YouTube co-founder had posted video of the rapper's elaborate proposal on his new website, MixBit, which preceded the event airing on Kim's popular E! series.

He argued that the confidentiality agreement that he signed was not binding on MixBit, and therefore he had not violated any terms.

The pair insisted he had snuck into AT&T Park - the site of the proposal - with the intention to film and they only allowed him to stay on the property after he agreed to sign the non-disclosure document.

The 2nd District Court of Appeal in Los Angeles upheld the ruling, saying West and Kardashian have shown a likelihood they could win a case on claims of breach of contract, fraud and unjust enrichment.

The hearing upheld the previous ruling, and the showbiz couple can now go ahead with their bid to seek unspecified damages.

Following the news the reality star was spotted out in New York City sporting a deeply plunging V-neck dress.

She showed off her famous curves in the body-hugging dress, which the mother-of-one coupled with a pair of strapped black heels.

She opted not to wear accessories on the outing, but styled her hair in a center part, and slicked back into a ponytail.

Kim was spotted solo on the walk, without young daughter North or husband Kanye, with whom she tied the knot in May.

New episodes of Kim's series Keeping Up with the Kardashians air on E!, Sundays at 9pm.
