Model ex-girlfriend of Gerard Butler who claims photographer got her pregnant during sexual assault sees rape charges dropped because DNA proved the baby wasn't his

A model ex-girlfriend of Gerard Butler who accused a photographer of getting her pregnant during a rape saw the case collapse because she got pregnant and DNA confirmed he was not the father, it has been reported.

Alesia Riabenkova, 22, who has appeared on the covers of Glamour and Elle magazines, claims she was raped when she went to his condo to talk about her struggling career, The New York Post reported.

The pair allegedly discussed a photo shoot over champagne, but 45 minutes later, the Latvian native told the doorman she had been attacked and asked him to call 911. 

Police arrested the photographer and he spent a night in custody. However supposed holes in her story and an inconclusive rape kit means the charges were reduced to sexual misconduct, and the entire case was eventually dropped.

In January 2015, Riabenkova then made the shocking claim she was impregnated during the alleged rape and wanted an abortion.

The District Attorney's office asked the clinic to keep the biological material for subsequent testing.

The lensman's lawyer Tom Kenniff then asked for a DNA test, which proved the cameraman involved was not the father. 

As a result, the case was closed and the documents sealed.  

He told The Post that his client had 'fooled around' with the model but didn't have sex with her.

He added: 'She tried to destroy my client’s life, and she should be punished for it.' 

Mr Kenniff also told The Daily Mail Online: 'The conventional wisdom is that there's a sexual assault epidemic in this country, I don't know if that's true or not. what is certain, though, is that there is an epidemic of false accusations of sexual assault taking place everyday.

'In case after case we see the names of otherwise upstanding individuals forever tarnished by the stain of false rape allegations. 

'Rarely are unscrupulous accusers who perpetrate these lies ever called to account for their actions by public prosecutors.' 

Video surveillance purportedly shows the model standing in the lobby of the building after the alleged incident without a 'care in the world'. 

Riabenkova, however, will not be facing false-report charges. 

She dated the 45-year-old British actor between 2012 and 2013. The catwalk stunner also started in the 2008 film Conspiracy.
