Dashcam footage shows 'non-violent Christian' pastor aggressively lunging at a state trooper who was trying to rescue him from floodwaters before the officer shot him dead

  • J.R. Fischer said that his son, Nehemiah Fischer, 35, was a man of God who studied the Bible daily
  • The Oklahoma Highway Patrol said Fischer was fatally shot on Friday by troopers near Tulsa after a physical altercation
  • Nehemiah was pronounced dead at the scene and his brother Brandon was arrested for assault and public intoxication

The Oklahoma Highway Patrol released a portion of a dashboard camera video during a press conference Monday showing a married pastor lunging at a state trooper moments before he was shot dead.

Nehemiah Fischer, 35, was gunned down by two officers Friday night near Tulsa after a scuffle.

The release of the dashcam video came after Fischer's father and wife made statements to the media claiming that the assistant pastor was a man of God who was not capable of violence and had deep respect for law enforcement.

OHP spokesman Capt. Paul Timmons told reporters at Monday's news conference that Nehemiah Fischer was shot after being ordered to leave a flooded area.

Moments before gunfire erupted, Mr Fischer allegedly grabbed a trooper and knocked him to the ground.

In the video, a pair of OHP troopers, identified Monday as Mark Southall and Michael Taylor, are seen repeatedly asking Nehemiah Fischer and his brother, Brandon, to leave a flooded area and seek higher ground.

As the siblings tramp through water toward the officers, the assistant pastor attacks one of them, prompting his partner to draw his service weapon.

Fischer's father, J.R. Fischer, told The Associated Press Monday that the aggressive behavior didn't sound like that of his son, who studied the Bible daily.

‘When it came to being a Christian man, he was the real deal,’ he said in a phone interview.

According to police, the brothers were near a vehicle surrounded by floodwaters in Okmulgee County, about 20 miles south of Tulsa. The troopers told the men to get out of the water, Timmons said.

Before the video was shown to the public, J.R. Fischer said it wasn't clear if his sons knew who had told them to get out of the water.

‘If my son would have known that this was an officer, he would have never assaulted him,’ he said.

But Timmons said the video makes it clear that the troopers identified themselves as the men approached the officers. Only one trooper is visible in the video after the scuffle begins, and his gun is raised.

Timmons said both officers fired their weapons, including Trooper Mark Southall, who had been knocked to the ground.

The attorney representing both troopers further claimed that Mr Fischer had a gun on his hip and held Trooper Southall's head underwater.

'They [Fischer brothers] might be great guys, I don't know, but they're obviously cursing state troopers and Nehemiah attacked the guy because when he gets up to him, it's well enough lit that he knows he's knocking a state trooper to the ground and on top of him,' Gary James told the station NewsOn6

Both troopers were placed on administrative leave in accordance with OHP's standard practice.

Southall has 8 years' experience and Taylor has been on the force for a year.

Troopers said they recovered a weapon belonging to Nehemiah Fischer at the scene. J.R. Fischer told the AP that his son had received a .380 handgun for his birthday.

Nehemiah was pronounced dead at the scene and Brandon was arrested for assault and public intoxication.

Nehemiah Fischer was killed during a confrontation with two state troopers who were trying to rescue him and his brother from rising flood waters Friday. However, his wife questioned the troopers' account.

The two troopers responded to a stranded motorist call at about 9.30pm Friday and found Nehemiah and brother, Brandon Fischer, 41, with two vehicles trying to move one from a roadway amid fast-moving waters.

Police said that a physical altercation ensued and a trooper fatally shot Nehemiah in self-defense.

But Nehemiah's wife, Laura Fischer, said that she could not imagine that happening, FOX reported.

Mrs Fischer was adamant that her husband, an assistant pastor at Faith Bible Church in Tulsa, and Brandon, would never attack troopers.

She said : 'He [Nehemiah] was the nicest person I’ve ever met. He was very giving. He made me want to be a better person.

The newlywed couple would have celebrated their one-year wedding anniversary later this month.

Oklahoma Highway Patrol Capt. Paul Timmons said the confrontation occurred as the men were exiting the water after the troopers told them to leave the vehicle and come to safety on higher ground, CNN reported.

Details of what led to the altercation are unclear, but Timmons said the two brothers were 'really upset' about having to leave the vehicle in the water.

Neither trooper was injured.

'[The troopers] were trying to get them to come out of the water,' he said. 'They were worried about them getting swept away.'

Timmons said Nehemiah had a weapon, according to CNN. Officials have not said if the weapon was used or shown.

However, a friend of Nehemiah, Mike Haesloop, told The Guardian that the 35-year-old is 'not the kind of guy that’s going to pull a gun on anybody'.

'He’s more one that’s going to pray for you,' he said. '...I don’t get it. None of this is making any sense.'

Mrs Fischer described her husband, who owned a construction company, as a church man and not a fighter.

The woman spoke through tears as she told a FOX reporter of how she was so thankful for her life with Nehemiah.
