Mel Gibson told he can take daughter Lucia with him to Australia for next movie project Hacksaw Ridge after facing ex partner Oksana Grigorieva in court 

Mel Gibson has been told he can take his daughter Lucia with him when he goes to Australia to film his next movie project.

The actor went to court on Friday after he and ex partner Oksana Grigorieva were at loggerheads over whether the five-year-old could go Down Under with him when he works on Hacksaw Ridge later this year.

However TMZ has learned that the Australian actor, 59, has been told he can take Lucia with him for a month and will also get to spend time with the little girl in Los Angeles before he leaves the country.

Oksana, 45,did not want their daughter to go and objected to her spending time overseas with her father.  

Mel is planning to start shooting during the Australian Summer.

Sources have told the website Mel is a hands on dad and is very involved in his daughter's life.

He now has just over 50% physical custody of Lucia.

Sources also told TMZ that another part of their disagreement was over which kindergarten the little girl was going to.

However at the hearing they are said to have told the judge they want to become better co-parents of their daughter. 

Mel and Oksana split in 2010 - in Mel admitted to a battery charge filed by his ex.

It was reported that Gibson initially offered his ex a settlement of $15million, but she refused.

The actor will appeared in a Los Angeles courtroom in May 2014 asking for the charge to be expunged from his record,according to RadarOnline

Last year Oksana got herself in hot water with the actor after she violated a confidentiality agreement by doing an interview with Howard Stern.

According to TMZ a judge ruled the Russian singer was never supposed to talk about her ex -even in an obtuse manner. 

She was forced to forfeit the remaining installments of her $750,000 settlement of which she was apparently still owed half -- $375,000.

 Oksana then filed or bankruptcy saying she was over $400,000 in debt.

Mel was in Australia in May scouting locations for the movie, which is based on the story of Desmond Doss. 

The medic and war hero was a Seventh Day Adventist and refused to bear arms on religious grounds.

Andrew Garfield will be appear in the film in the lead role and it is the first movie Mel has made in Australia since Mad Max: Beyond Thunderdome in 1985.

It is also his first shot in the country as a director.

The Daily Mail as contacted a representative of Mel Gibson's for comment.
