It is a very personal matter that she would understandably like to keep private.

But on Thursday, actress Sofia Vergara, 42, was faced with pro-life protesters at the Magic Mike XXL premiere, some of whom held up banners begging the Colombian actress to give her much-discussed frozen embryos a chance of survival.

Sofia and her ex-fiancé Nick Loeb have been locked in a bitter legal battle over the two frozen embryos created from when they were still together and going through in-vitro fertilization.

It is not clear if Sofia caught sight of the banners, although they were on clear display as she arrived with her new fiancé Joe Manganiello. 

Other banners said messages including 'lives created should be lives protected' and 'Sofia: Unfreeze your daughters, unfreeze your heart.'

In court documents that were revealed last month Vergara claims that her former flame is just trying to take advantage of her career by publicly fighting to take the embryos to full term.

But Loeb insists his intentions had nothing to do with her and instead he is taking her to court because he views the two remaining female embryos as his daughters and he believes in life from the moment of conception.

The legal papers claims the actress told Loeb she was pro-life and that she promised each embryo created would ultimately be implanted into a surrogate.

Loeb states if he had known that the embryos would not be saved after they split up, he would not have agreed to the IVF.

Text messages between Vergara and Loeb detail the moment they found out the embryos had been successfully fertilized.

Loeb believes these fully illustrate that Vergara viewed the embryos as life from the moment they were fertilized.

In March 2013, Vergara text Loeb saying: 'We have 5 embrios (sic). She [the doctor] cant believe it.'

The 39-year-old businessman and banking heir replied, 'Wow' and the pair then discussed what would happen if one embryo was implanted and the other four were left frozen.

Loeb wrote: 'Now what. You can't keep 4 frozen lives forever or kill them, we will go to hell.'

Vergara, who already has an adult son from a previous relationship, replied 'We r going to hell regardless.'

She added later on: 'I'm doing it because I want you to have a baby.'

Two of the five embryos survived to viability and the court papers state the pair had an embryo implanted in a 44-year-old friend and employee of Vergara, despite advice from doctors to use someone else.

They state Vergara gave the woman gifts worth approximately $200,000 and covered her mortgage payments.

But the embryo did not take in the surrogate and when they tried again it also failed.

They decided to undergo a second round of IVF and they signed documents about what would happen to the embryos under certain circumstances.

The pair had to decide if one of them died would they - a) donate the embryos to research, b) thaw them out with no further action or c) if one of them died, allow the embryos to be used by the other one.

Vergara wrote that if one of them died, the embryos must be destroyed. The papers claim that she 'demanded' Loeb do the same and he did it under duress.

Loeb claims he was 'surprised' she had decided for them to be thawed as she had told him about her Catholic faith.

When he told her he did not agree, the papers claim she then began 'vigorously berating him' in the office.

The legal documents claim 'such abuse was common' in their relationship and Vergara was 'on many occasions physically, emotionally and mentally abusive to her fiance.'

In May 2014, the pair split up and Loeb texted Vergara: 'We still have those 2 frozen babys so I guess we r always going to have some kind of weird connection.'

The papers state Loeb told her that although they were no longer a couple, he still wanted to implant the embryos and become a father, but Vergara said she wanted them destroyed.

He tried to get Vergara to agree that if one of them died the other one would have control of the embryos, but she did not respond.

Loeb filed a complaint over the embryos last August in California.

He now wants to have the embryos implanted into a surrogate.
