The shop where Ariana Grande was seen licking donuts and was filmed saying she 'hated' America has failed it's health inspection.

According to TMZ on Thursday, Wolfee Donuts, in Lake Elsinore, California was told one of the reasons for it not passing the check was down to 'customers licking donuts incorrectly placed on counter.

Now the shop owner, where the singer was seen in footage licking the sugar coated goods and also heard saying: 'I hate Americans. I hate America,' is pushing for for charges to be brought against her of 'cross contamination.'

Ariana is not mentioned by name in the report -- but TMZ says a manager told the inspector the employee didn't know Ariana had tongued the goods, and '"placed them back in display case for sale."'

The establishment has been given a week to sort out the issue and had one letter docked by the health department.

They have been left with a B rating.

Ariana Grande licks donuts and declares she hates America

The footage of Ariana emerged on Tuesday, and on Wednesday she canceled her appearance at a MLB All-Star Concert this Saturday.

She is being replaced at the gig in Cincinnati by Demi Lovato.

In a statement on Wednesday, the Florida-born artist insisted she was pulling out of the event because she's had her wisdom teeth removed and apologized for her comments made during a trip to a store on July 4 that were caught on video by a security camera.

Meanwhile, authorities are now looking into the incident and seeing if they might press charges as reports surface claiming the store owner wants to have the two charged for 'cross-contamination.'

The issue is if food-borne illnesses or germs are transferred as a result of the 'licking' it could be potentially seen as a crime.

'I am EXTREMELY proud to be an American and I’ve always made it clear that I love my country,' Ariana said in the statement about the incident.

'What I said in a private moment with my friend, who was buying the donuts, was taken out of context and I am sorry for not using more discretion with my choice of words'

The 22-year-old went on: 'As for why I cannot be at the MLB show, I have had emergency oral surgery and due to recovery I cannot attend the show. I hope to make it up to all those fans soon.'

'That being said let me once again apologize if I have offended anyone with my poor choice of words.'

Despite her apology, Mayra Solis, the cashier on duty at Wolfee Donuts, said the singer was 'rude.'

The controversial incident took place at Wolfee Donuts in Lake Elsinore where, according to TMZ, she and her new love interest, backup dancer Ricky Alvarez upset staff members with their behavior.

At one point, the pair shared a couple of kisses but when a fresh batch of donuts was placed on the counter, the singer is heard saying: 'What the f**k is that? I hate Americans. I hate America.'

The My Everything performer said Wednesday her remarks were not intended as hateful towards America and Americans.

Rather they were an expression of frustration with the food industry and a rant about 'the fact that the United States has one of the highest child obesity rate in the world.'

In the doughnut shop video, Ariana and Alvarez can be seen at first pretending to lick the doughnuts on display on the top of the counter.

Daring each other to get closer, it appeared as if the backup dancer and then the pop star may have actually licked the sugared treats.

Whether they made contact is hard to tell but according to TMZ, 'sources in the shop say it was definitely too close for their liking - especially since Ariana pulled the stunt when no one was looking, and they would've tossed the contaminated doughnuts if they knew.'

So unimpressed was the store that someone leaked the security footage.

On Wednesday, police in Lake Elsinore said they and Riverside County public health officials were investigating the leaked video.

An account of the incident came from 22-year-old Mayra Solis, the cashier on duty at the donut shop who claimed the singer not only didn't purchase any of the donuts she licked but also told the Associated Press: 'she was really rude.'

Meanwhile, Lovato has also issued a statement expressing her delight at being asked to perform at the free concert in Cincinnati.

'I'm so excited to be headlining the MLB All-Star Concert," she said Lovato. 'I hope my fans in Cincinnati are ready to get ‘Cool for the Summer!''
