Bing loses fight with Penn

Movie producer Steve Bing - the father of Liz Hurley's child - has been dealt a serious blow in a £6million legal row with actor Sean Penn over a film the pair agreed to make.

The pair decided to sue each other after their deal to make a comedy called Why Women Shouldn't Marry fell apart.

Bing is suing Penn for £9million in damages for money he alleges he paid to Penn to hire Woody Allen to direct the film, as well as various other production costs.

He also claimed Penn never intended to appear in the film and avoided signing an agreement for six months.

But a judge in Los Angeles dismissed four of Bing's claims, including extortion, because he said no money was paid to Penn.

The actor meanwhile, has claimed Bing forced him off the project because of his controversial pre-war visit to Iraq.
