Empire State Building fights to ban photographer over his 'dangerous' X-rated photo shoots of topless models cavorting in front of stunned tourists

As one of the world's tallest skyscrapers, the Empire State Building offers spectacular, unspoiled views of New York's famous skyline. 

But when a controversial photographer staged a photo shoot with a topless woman surrounded by unaware tourists, officials were outraged, and they are now looking to ban him from the Big Apple building.

Allen Henson first captured the scantily-clad women on the observation deck as part of his 'boobs around town project' - taking pictures of half-naked women in public places.

The commercial snapper has been active on social media in his campaign, and is now asking for more models 'who aren't afraid of heights' to join his project

In June he put another casting call on Instagram, asking for a 'model who isn't afraid of heights', prompting concern with the building's attorney.  

Last year, the Empire State Building sued Henson for $1.1million over the stunt, the New York Post reported, and the case is still pending.

They claimed he didn't have permission to stage the 'objectionable and inappropriate' commercial shoot.

But earlier this week, attorneys were reportedly back in front of a judge in a bid to stop him from ever returning to the 'World's Most Famous Building'. 

Lawyer David S. Tannenbaum even claimed that that Henson's explicit photography could be a danger to tourists on the viewing deck. 

He also argued that a shoot in the future would cause 'serious and irreparable injury' to the building.
