Kelly Rutherford seems to be making the most of every day with her children.

Having had them taken away from her once, she knows both the pain and the possibility of it happening again.

The 46-year-old spent another fun filled day with eight-year-old son Hermes and six-year-old daughter Helena in New York on Monday, knowing that she may not be able to again once the summer ends.

The actress is currently locked in a bitter custody battle with her ex-husband Daniel Giersch, who wants their children brought back to Monaco where he lives.

After being granted temporary sole custody of them by a judge in the tiny principality, the Gossip Girl star is determined to make every moment count while her kids are with her in the States.

On Monday she brought them to the Children's Museum of the Arts, where the siblings took a painting class, secretly snapped and shared by their mom on Instagram.

On Thursday and Friday she had a less enjoyable couple of days as she took to the stand in an LA court to argue why her kids should be allowed stay with her in the United States.

The children have been living with Giersch on the French Riviera since 2012 where he moved with them after his American visa was revoked following the couple's divorce.

Kelly broke down in tears a number of times as she tried to counter Giersch's legal team's argument that she doesn't live in LA but in New York, and thus the Californian court does not have jurisdiction.

She argued that the main reason she rented an apartment in New York was to be half way closer to Europe, where she was forced to fly to see her children, which she claims eventually bankrupted her.
