Kelly Rutherford puts on a happy front with daughter Helena at Blushington bash after New York court rejects her custody case

Kelly Rutherford was dealt another blow when the New York court refused to take on her child custody case.

The 46-year-old actress put that disappointment aside and plastered on a smile while attending the Blushington Grand Opening Party at Le Parker Meridien Underground in New York City on Tuesday.

She was joined by her six-year-old daughter Helena, who clearly made mom's day by enjoying the bash thrown by the make-up and beauty lounge as much as Kelly did.

Kelly couldn't contain her smiles as she hugged her little girl, who was dressed in a pretty blue frock and silver slip-on sandals.

The former Gossip Girl star was clad in summer attire too, wearing a white tank T-shirt and a beige fringe skirt along with beige strapped heels.

The pair indulged in their own mommy-and-me beauty session, sharing the same cosy swivel chair.

As this appeared to be a girls affair, no wonder Kelly's son Hermes, eight, decided to sit this one out.

Kelly and her ex-husband Daniel Giersch have been embroiled in a bitter custody battle after a court ruled in 2012 their children should live with him in Monaco.

The former Gossip Girl star, who is fighting to return her US-born children to America, has referred to the case as a 'legal kidnapping'.

A court ruled that the children should live with Giersch in Europe, but spend summers with Rutherford in America, after his US visa was revoked.

'Neither California or NYC are taking jurisdiction,' Kelly told People. 'So who in the US has jurisdiction of my America-born, US citizen children?'

Last Thursday, a California court ruled it did not have jurisdiction, as neither Kelly nor the children live in the state anymore.

The actress spends most of her time in New York, because it is easier to fly to Europe from there.

'They were sent there by California temporarily to accommodate Daniel's visa issue, and now California won't bring them home,' Kelly told People.

However, the actress was able to enjoy some quality time with her children who are spending the summer with her in New York City.

Mom and children alike seemed happy and relaxed at a Ovarian Cancer Research Fund event in the Hamptons on Saturday.

Although she filed for bankruptcy in 2013, claiming debts of $2 million including $1.5 million spent on legal fees to fight the custody decision, the actress has no plans to give up her custody fight.
