Noah Cyrus, 15, risks brand-new permit as she takes sister Miley, 22, out for a spin despite needing a driver over the age of 25 in the car

The youngest of the Cyrus clan may be about to set the record for the shortest ever time holding a driver's permit.

Noah Cyrus was spotted driving big sister Miley, 22, around Los Angeles on Wednesday, seemingly in violation of her new driver status. It is was not stated that there was an adult driver in the back seat.

The 15-and-a-half-year-old was only able to get a provisional permit this month and is required to have an adult driver with her at all times.

Until her 16th birthday and she passes her behind-the-wheel test, the mini pop star in the making is required to have a driver who is at least 25 and according to the DMV, 'he or she must sit in a position close enough to take control of the vehicle, if necessary.'

At 22, Miley does not cut in in the law's eyes as an adult driver and even if there was an older adult in the car -which did not seem to be the case - they would need to be in the passenger seat - not Miley.

The singer is also the reason the world knows her sister may have been breaking the law.

The Can't Stop, Won't Stop star was such a proud sister that she could not help but post pictures of Noah driving after she passed her written test and got a provisional permit.

On Wednesday, the two sisters headed out in Sherman Oaks, California, for lunch at Hugo's Tacos with Noah serving as chauffeur.

Sitting in the passenger seat, Miley snapped a picture of the new permit holder behind the wheel.

The star posted the snap on Instagram for her millions of followers - and the police department - to see.

While proud of her little sister's learner's permit in an earlier picture taken on another day, Miley admitted she was a little scared with Noah driving.

In the caption she said: 'Terrifying but f**king cool to see this lil baby soooooo grownt! Feelin old!'

The 15-year-old star was also not driving around in a car tailored to learner drivers either, instead on Monday, she was motoring around town in what appeared to be her sister's 2014 Maserati Quattroporte - which is worth over $100,000.

Despite being under 16, this is far from the first time that Noah has hoped behind the wheel.

Back then, the youngster and her dad escaped any fines or legal consequences as police did not see the incident first hand.

Despite the potential of getting in big trouble if spotted, neither Noah or Miley seemed concerned as the pulled up the their lunch destination.

After parking her new whip, Miley walked with her arm around the new learner driver to grab some Mexican.

For their lunch, the 15-year-old - who has reportedly been signed to record label Universal - wore a pair of Free City sweats with a cropped black and white long sleeved top and a black cap.

Miley meanwhile dressed to beat the heat, wearing a pair of very short white shorts with a loose fit black T-shirt.
