All seems to be getting better for Tom Brady this week.

On Thursday his four game suspension was overturned, allowing him to play with the New England Patriots when they have their season opener against the Pittsburgh Steelers on September 10.

That same day his wife of six years, Gisele Bundchen, was spotted at the Massachusetts Gillette Stadium where the athlete was playing in a pre-season game. That throws cold water on claims the 35-year-old Brazilian bombshell is looking into divorcing the 38-year-old Superbowl star.

According to Us Weekly, the Vogue favorite recently consulted a divorce lawyer, but Tom is allegedly not taking her actions too seriously.

‘Tom thinks it’s only a threat,’ a source claimed to the magazine. ‘But this is definitely a rough patch.’ The insider added: ‘Things are very tense right now. This could be the end of them.’

Us Weekly also noted that the couple, who have five-year-old son Benjamin and two-year-old daughter Vivian, did not celebrate their birthdays together this year – his last month and hers in July.

Us Weekly’s source alleged that the football player has ‘become very nasty and irritable and started acting out on’ Gisele. The latest report comes a week after an insider claimed to People: 'There have been a lot of stresses in their marriage in the last year, especially during football season.'

The source added: 'Tom is singularly focused on his career and sometimes Gisele feels left out. There have been arguments.'

She didn't even congratulate Tom on his court ruling on Thursday when the Patriots quarterback saw his four-game ban overturned by a federal judge. The four-time Super Bowl winner was suspended in May.

It was alleged that Brady was privvy to Patriots staff wilfully deflating footballs in the 45-7 rout of the Indianapolis Colts in the AFC Champsionship game.

Ted Wells, an independent attorney hired by the NFL, dished out the original ban, which was subsequently upheld by NFL Commissioner Roger Goodell.

After countless attempts at settlement, US district Judge Richard Berman decreed that the suspension was 'premised upon several significant legal deficiencies.'

Judge Berman had urged the parties to come to agreement, but with the season kicking off next week, he took matters into his own hands.

In a 40-page document, Berman said it was unfair that Brady was subjected to a four-game ban, the same dished out to players who break the NFL's substance and abuse policy.

'The court finds that no player alleged or found to have had a general awareness of the inappropriate ball deflation activities of others or who allegedly schemed with others to let air out of footballs in a Championship Game and also had not cooperated in an ensuing investigation, reasonably could be on notice that their discipline would (or should) be the same as applied to a player who violated the NFL Policy on Anabolic Steroids and Related Substances,' he said.

Brady has insisted his innocence throughout, while the NFL announced their intention to appeal Berman's decision.

'We are grateful to Judge Berman for hearing this matter, but respectfully disagree with today's decision. We will appeal today's ruling in order to uphold the collectively bargained responsibility to protect the integrity of the game,' Goodell wrote in explaining his decision to appeal.

'The commissioner's responsibility to secure the competitive fairness of our game is a paramount principle, and the league and our 32 clubs will continue to pursue a path to that end. While the legal phase of this process continues, we look forward to focusing on football and the opening of the regular season.'
